In Florida it is if you also refuse a blood test....................

That's the proper remedy. Driving is a privilege. But self-incrimination is part of the Bill of Rights. It will be interesting when OBD III is implemented in our vehicles which will provide Law Enforcement with direct access to your vehicle's operating parameters, including it's speed, in real time. So will cops monitoring your vehicle's speed by tapping into it's computer be an act of self-incrimination? If you think Big Brother is here now, you ain't seen anything yet.

I believe in NY State you automatically lose your license for a minimum of 6 months.

This is why it was important that this happened.

Breathalizers are not that accurate anyway. Blood tests are what tells your blood alcohol level.

I'm assuming it depends on the laws of each state. I live in NY State, and according to an online source, the prosecutor can use your refusal as evidence. If you refuse, your license is suspended for one year. Other rules apply for additional refusals.

That is the obvious question and back when journalism meant something, if the reporter didn't touch on that question, the editor would kick it back.
