What if I want to drive on the LEFT side of the road?

We'll give you a one way ticket to Britain.

Self driving cars don’t prevent people from drinking themselves to death

DWI is definitely not a criminal offense in NJ. You aren’t fingerprinted when arrested, there is no pre-trial intervention for it, there is no right to a jury trial if you fight it, and it can’t be expunged because it is only on your driving record. I suspect these laws are a holdover from when state governments had power.

There is a movement in the legislature now to amend the suspensions as well, so people can drive at least to and from work.

Many people don’t realize that blood alcohol content is just one way to get a DUI; you can have a very low BAC and still get a DUI if the cop can make the case you were impaired. On top of that, anyone who drives after taking medication that warns not to operate a vehicle risks a DUI as well.

Then the argument is over what constitutes existing evidence. If your breath contains an undue percentage of alcohol, that’s evidence - which exists, the breathalyzer simply acquires & quantifies it. We’d have to objectively define a limit to such acquisition (sticking device in one’s mouth, vs sampling air inches away).

Prevent it? Ha! They would promote it!

And no, I’m not kidding.

that is not the test the court addressed. The court said forcing a suspect to take a deeper breath than normal was beyond the mere presense (plain sight) test.

The machine requires the subject to force air into the machine.

Ah. So a mere technical innovation whereby simply breathing on a surface would be acceptable? That can be arranged.
