The suspect, identified as 31-year-old Seth Brandon Spangler was previously arrested for methamphetamine and weapons possession.

IMO, if you shoot another human, you’ve just signed your death warrant whether you were successful or not.
You don’t use a gun unless it’s to kill. The utilization of one is an admission of intent.
If you shoot at a person (in a criminal manner), you have killed them in your mind.
Thus, they are guilty of murder.
