Arson is considered up there on a par with committing murder. It is classified as a felony because of the potential of causing death. Depending on circumstances, the penalty could be death.

Arson in Texas is always a felony, usually a 2nd or 1st degree felony, whether the fire started produces substantial damage or not. Long, hard time all around.
