Other members of the FBI's Hostage Rescue Team involved in the stop of refuge occupation Robert "LaVoy" Finicum testified before a federal grand jury that returned an indictment against their colleague, Agent W. Joseph Astarita.
Proescutors have asked the court for permission to share transcripts of the agents' testimony with a nationally recognized ballistics and trajectory expert who they may call as a witness at trial.
Astarita is accused of firing two shots at Finicum or his truck and then lying about it. The shots didn't hurt Finicum. State police fatally shot Finicum a short time later. Finicum appeared to be reaching for a gun at the time, investigator said. He had a loaded gun in his inside jacket pocket, they said.
The government's case against Astarita rests on videos taken by an FBI airplane flying overhead and cellphone video from Shawna Cox, a passenger in Finicum's truck, as well as ballistics and trajectory evidence developed by the state police crime lab and Deschutes County Sheriff's Office, the prosecutors said in a recent court filing........

The preliminary court work continues ahead of a trial planned for W. Joseph Astarita in February 2018 over his lying about shooting at LaVoy's truck.
Its possible that Astarita's shot injured Ryan Bundy with feds interested in the bullet still lodged in his shoulder. Bundy refused medical treatment after his injury wanting to keep the shrapnel for "evidence".
Grand Jury is secret until the Indictment is handed up. There is a transcript of everything said. Transcripts must be given to defense counsel. Prosecutors don’t have to ask for permission to share with experts. They are trying to buy time as it seems like more than a year and a half has passed. Defense lawyers already know what was said. They probably have their own experts ready.
A murky mess that leads to protecting law enforcement because they’re better than the rest of us.
As I’ve noted before, the highest paid unionized government employees that help with their large salaries and pensions etc. etc. to bankrupt governments local, state and federal are law enforcement-firefighters.
