As expected by the bien-pensants of the mainstream media, a New York federal district judge dismissed Sarah Palin's libel suit against the New York Times.

The decision reached what is, for the Progressive media, a politically correct result, which is that a scruffy conservative like Palin cannot be allowed to sue the New York Times.

The author explains how the judge in the Palin v NYT case erred in his decision.

From the article:

"Palin's chance of winning an appeal are good, and one would certainly like to see the courts impose some sense of responsibility on the media.  In this case, as in other libel cases, the judge delivered a paean to robust political debate, but he ignored the harm to that debate that occurs when "made it up" reporting becomes the norm."

I’ve thought all along that the NY judge would boot it because it would be preferable to lose on appeal than to be the one that sets such an unpopular (amongst libs) precedent. Let’s say Palin wins on appeal, you know for sure the NYT and it’s majority owner Carlos Slim will continue to appeal, and let’s hope it ends up in the Supreme Court, where the answer might not be to their liking. This is the only way to acomplish Trump’s promise to reform libel laws - a test case has to challenge the Sullivan standard at the Scotus level. And who better to bring it?

Good article. If the author is correct, and Sarah has a good chance of winning on appeal, I hope she appeals. I also hope she asks the public to help her pay for it.

When you read the actual ruling, it is plain that the judge had to engage in Olympic worthy legal gymnastics to support his ruling.

There were three points of law in the ruling, of which Palin won two with no contest.

The third point of law, the judge gave to the Times, after much verbal diarrhea, and wrongly asserting that the third point outweighed any value of the first two.

A complete legal hatchet job.

I hope she appeals. She will win.

I would just call it what it was. It was outright lying by the judge regarding both the facts and the law in the case.

Thanks for your comments. It’s great to hear from someone who read the judge’s ruling.
