'Somebody Help Me!' Nurse Arrested After Refusing to Draw Blood

(SALT LAKE CITY) — A Utah police officer's body camera video shows a hospital nurse being handcuffed after refusing to draw blood on an unconscious patient.

The video taken at University Hospital in Salt Lake City shows nurse Alex Wubbels calmly explaining to Salt Lake detective Jeff Payne that she couldn't draw blood on a patient who had been injured in a car accident. She told the officer a patient was required to give consent for a blood sample or be under arrest. Otherwise, she said police needed a warrant.

The dispute ended with Payne telling the nurse she was under arrest and physically moving her out of the hospital while she screamed.

The Salt Lake Tribune reports Wubbels was not charged. Police have started an internal investigation, but Payne remains on duty.

You may want to revise that. The mayor and police chief have apologized, two officers have been placed on leave, and there is going to be a criminal investigation.

I understand it’s human nature and we all can feel that way, but that us exactly what conservatism and bring civilized us about - to rise above or baser natures.

If cops want the respect of the citizenry, they need to be able to distinguish between street thugs who might present a real threat, and a nurse doing her job.

I feel so badly for this woman, and all good, hardworking citizens who are subject to this kind of police state thuggery.

The nurse was commended on her courage for standing up for the man’s rights [turns out the trucker’s also a reserve officer in another department and was never a suspect] ... “Jr” here who was abusing his authority is in time out ... his department’s apologized ...and the nurse’s been asked by Jr’s own department to participate in training officers for handling such contingencies in the future.

Self-defense is obviously a conservative principle. Surrendering to thugs is what you advocate.

No idea what led up to the moment, but if he couldn’t show probable cause and get a warrant then he shouldn’t be asking to begin with.,,guess that is what I was trying to infer

An interesting take on this by a poster on another website:

Truck driver was innocent and a victim of a police chase.

CDL drivers live and die by their blood alcohol/drug content when involved in accidents.

Cops wanted blood to find out if the guy was drunk or on drugs to use to blackmail him if he decides to sue the department for being injured as a result of their high speed chase.

Cop at hospital was there to make sure a blood sample was taken to cover their assess.

The officer at the ER was truly requesting the sample for the victim’s own protection, not to prosecute him.

The truth is she was following the law, and LEOs were not. Not only was she following the law but she was also following hospital policy that was based on an agreement hospital had with LE Agency.

She was very polite and very professional in her interaction with him until he grabbed her. She never did refuse his request, she only pointed out to him what the agreement between the hospital and LEO was in such circumstances.

The law the LEO was trying to use was changed in Utah in 2007 (not recently as some have claimed), implied consent was no longer the law.

The three conditions for LE to get blood drawn at that hospital and in order to comply with the law- LE must have at least one of the three: Patient under arrest, warrant, patient consent. None of those conditions were met.

If she had not made an effort to protect her patient’s care and rights she would herself be in violation of the law.

LE was not only trying to violate the law, he was trying to bully her into breaking the law regarding her duty to her patients and trying to bully her into violating hospital policy.

People said she should have called the charge nurse, in an updated article they said she was the charge nurse. She also had her supervisor on speaker phone and was doing as her supervisor was directing her to do. The head of the burn ward was also in the room, and LE didn’t listen to him either.

She did everything she was supposed to do. She did it all in a very polite and professional way.

One more thing - if there was no express consent by the patient or a legit warrant, the blood draw would be inadmissible for investigative purposes anyway. Which makes me really wonder what in the wide world of sports was that guy thinking, trying to accomplish.

If she had been taken to the jail and formally booked in, yeah. Cuffed, detained on-scene for a while and then released, nope.
