Attorneys for the man accused of murdering Kate Steinle on San Francisco’s Pier 14 two years ago want to present evidence at trial they believe will show their client didn’t steal the gun allegedly used in the killing, but found it moments before the shooting.
The defense believes if it can show Zarate, 54, didn’t steal the gun, it will back up its argument that he found the weapon on the pier, and Steinle’s death was a tragic accident, not a cold-blooded killing.
“The series of break-ins is consistent with a skilled auto burglar or a ring of thieves who managed to break into at least seven cars undetected - not the defendant, who has no history of committing theft crimes,” Matt Gonzalez, the chief attorney for the San Francisco Public Defender’s Office, wrote in the motion.
Steinle, 32, was fatally stuck in the heart while walking with her father on the pier along the Embarcadero on July 1, 2015.
“He’s not charged with auto burglary. He’s charged with murder,” said Max Szabo, a spokesman for District Attorney George Gascón. “The question isn’t whether he broke into a car. The question is whether he pulled the trigger.”
Police arrested Zarate - a Mexican immigrant, who was in the country illegally and had been deported five times - near the scene.

I understood he fired the gun but it ricocheted and hit her, tragic either way of course but he can be found guilty of murder and not manslaughter.

This story makes my blood boil. Kate will be murdered again by these sick f*ck lawyers and sycophant illegal cheerleaders. BTW, will we ever find out what Federal agent “lost” his/her weapon in their car? Sometimes this country makes me vomit.

I’m not an elitist, but there should be some semblance of normalcy, an expectation of safety in public as she was.
Here is this beautiful woman out for a walk with her father, and she is gunned down and her family have to live with that tragedy.
All this because there was more sympathy for this social misfit, than there was for the cream of our society.
There she was in the prime of her life, of an age to soon be settling down, forming a family, and turning out new beautiful children for the next generation.
This guy not only killed her, but he robbed our nation of a very special resource.
I’m tired of these social misfits being given power to destroy others.
It’s time to get serous about illegal immigration, sanctuary entities, and the damage being done by them.

He has been “identified” as a Bureau of Land Management “agent,” but not named. Given the way that the BLM has behaved over the years, it’s long past time when they should be disarmed completely. If the BLM ever does need someone with a gun to assist them, let them call on the US Marshall’s service to provide the armed individuals. And that goes for a lot of other agencies whose primary for existence isn’t “hunting down” criminals. We have too damned many Federal and State agencies that are armed to the teeth, and when you have a “hammer” ( a gun for instance) everything is a “nail!”

What was her brother concerned about? Why Donald Trump of course. He didn’t like the idea Trump was angry about the death and wanted to clean things up so this sort of thing would be less likely to happen in the future.
Trump picked up her cause and ran with it. This her brother twisted to describe Trump as merely an opportunist.
