It just became harder for Trump to blow up Obamacare
Business Insider ^ | August 2, 2017 | Bob Bryan

Posted on 08/02/2017 8:30:00 AM PDT by Cboldt

It became harder Monday night for President Donald Trump to help engineer the collapse of the Affordable Care Act.

A federal court ruled that attorneys general in 17 states and the District of Columbia would be allowed to intervene in a case over crucial subsidies known as cost-sharing-reduction payments. ...

In 2016 a judge ruled in favor of the House, saying the CSR payments were illegal because Congress did not appropriate them. ...

But on Monday, the court ruled that the 17 states and DC could intervene and ... said ending the payments would be damaging to the states' citizens.

This is courts. Unprincipled, outcome-oriented, political hacks. Living high on the hog, on your dime.

This stupid judge thinks the states and the judiciary can compel the Congress to appropriate funds.

Ludicrous.

So much for our republic. Everything is controlled by the courts. The President can't even reverse an illegal EO from a past administration without the black-robed a$$holes getting involved.

I think they taught us in 8th. grade that the power of the purse lies with the LEGISLATIVE branch.

This ruling doesn’t sound like anything major.

This one is an even bigger hoot. The judges did get involved, The judges said the payments were unconstitutional.

But that was before Trump was president.

It just became harder for Trump to blow up Obamacare

The headline would have been more accurately expressed as "It just became harder for Trump to make good on Republican campaign promises of the last seven years", but obviously space considerations militate against that one.

The courts will led us to a third world state..

Unless Trump gets four more court picks..and then it will take thirty years

It's all wrapped up in the same case, now in the U.S. Court of Appeals for the District of Columbia Circuit. The court below found the payments unconstitutional.

I don't know that this ruling, on it's own, is major. But it does signal that the Courts are willing to force the payments to continue to protect some state interest, after the courts said the payments were unconstitutional.

Obviously, the courts are lawless.

Got it?

Not because it is legal but because it is ‘damaging (in their opinion) to citizens”

That’s a great new judicial standard! Just claim anything other than a march to socialism is “damaging” to citizens!

He doesn’t have to blow it up, just let it fail. It’s on the Democrats for creating it and on the Republicans in Congress for failing to fix it when they had the chance.

All opposition to repealing/replacing Obamacare is good for Trump.

Immediate appeal and request for stay of execution, until it is heard.

CLEAR misapplication of the law.

Not that big a stretch. Federal courts here in Missouri “required” our legislature to appropriate funds for purposes of school integration. Federal judges often have the attitude that they can compel anyone to do anything, the will of the people be damned.

They've been lawless for a very long time. Liberal judges should be sh** .... wait, hu**, no, tarred and feathered first, then hu** and sh**.

That'll fix 'em.

Sign an EO taking away Congress’s Obamacare special treatment. Make them eat the same cr@p sandwich they crammed down the public’s throat.

They’ll repeal Obamacare.

It's fairly major. At least unusual procedure.

Order Granting Motion to Intervene

The states didn't bother intervening until now. In other words, the states were not involved in the case at the trial court level.

These are amazing times. We had an election and the people voiced their decision. Yet, the so called “elected representatives” along with a court system and the media are representing and protecting the interests of the ruling elites, as if the election didn’t matter.

This certainly closer resembles a Communist style government vs. a Democratic Republic.
