How Rick Perry could fire Robert Mueller

Paul Butler is a professor of law at Georgetown University. In an interview with The Post on Thursday, he explained the various ways in which Trump could replace Sessions, if Sessions resigned or were fired.

There are four.

1. Trump nominates a new attorney general who is confirmed by the Senate....

2. Trump lets Rosenstein take over. As noted above, this is not Trump’s preferred recourse, since Rosenstein appointed Mueller and could fire him now if he wanted to....

3. Trump can appoint someone while the Senate is recessed....

This power has been abused. President Barack Obama’s recess appointment of members of the National Labor Relations Board was thrown out by the Supreme Court in 2014...

That leaves the fourth option:

4. The Vacancies Reform Act of 1998. This was the heart of what Butler discussed with us....

So, in other words, if Sessions were to resign, President Trump could appoint, say, Rick Perry, the secretary of energy, to be the acting attorney general? “The answer is yes,” Butler said, since Perry has already been appointed by Trump and confirmed by the Senate.

But there’s a catch....

Man, I chopped the hell out of this article. It starts - like all Compost articles - with the usual "Trump sucks" blatherings.

If I’m not mistaken, obama’s NRLB recess appointments were invalidated because the Senate wasn’t actually in recess when he made them.

It’s very far-fetched and absurd. Perry running DOJ? Get real.

The best option that I can think of is to fire Rosenstein. The person below him is a conservative, and she could take over the supervision of Mueller, even fire him. If we don’t have a conflict, we don’t need a special counsel.

Trump wont be able to make a Recess appointment because the Senate will not go into formal recess. To protect Sessions, they will stay in session by having a call to order every business day by a designated Senator and then in the absence of a Quorum adjourning until the next business day. This will go on until everybody returns after Labor Day. This effectively keeps Trump from firing Sessions and naming a successor and nobody expects him to leave the Deputy AG who appointed Mueller in charge.

But.... Trump needs to be very careful he does not do a repeat of the Saturday Night Massacre.

Firing Special Investigators and forcing A/G’s to resign can have drastic Nixonian results.

The difference between Nixon’s troubles and Trump seems to be that there has been an open, active coup in progress since the inauguration. There is absolutely no “Republican” Party to remotely cushion this president from this coup, because it is one big Congressional UniParty who want him out.

Trump may as well give it hell. I can’t think of a thing he has to lose for trying to drain the swamp. Obviously, the hill and their media are not going to allow it, if they have to impeach him to stop it. And they will have to impeach to stop Trump.

After that, voting will never matter again in the USA.

Sessions caused paralysis. He has toyed with the problematic edges but has launched NOTHING against those who have sabotaged the country and delivered those edges with which he toys.

I voted for and supported trump, but unless he curs his “Foot in the Mouth Disease”,he may lose me. His latest attacks on Sessions has really ticked me off. The Scaramucci appointment reminds me of the typical New York city IN YOUR FACE behavior that always was a great irritation in my many associations with people from across the country.

There seem to be constitutional grounds, and also the enormous conflicts of interest of Mueller, Rosenstein and Mueller's hirelings.

Someone in the WH really needs to pull together the best legal experts they can find and brain storm all the possibilities of undoing this string of questionable decisions.
