First Degree Murder with Special Circumstances
I would charge ALL OF THEM and go for the Death Penalty, their Supervisor included.
Now suppose it were you or I and we wanted to deliver a birthday party invitation to a friend, but instead knocked on the door or the wrong house and killed the owner of said house when he opened the door?
We would never see the light of day, and no cop, prosecutor or jury cop will say that it was a mistake.
Then again, you might be jumping to conclusions, BLM style.
That’s not how justice works.
A cop exercising good reason shouldn’t be held criminally liable for a mistake. Just the same as you shouldn’t if you acted reasonably and defended yourself. Whoever made the mistake of pointing then to that house may be criminally liable. They’re all certainly civilly liable. At least the department is. Criminality requires recklessness or malice of some sort and not simply “something bad happened”.
But having a drumhead trial isn’t how justice works.
Do you know how the average courthouse works? They are tight knit and closed societies that party hardy together. The courthouse crowed takes care of the courthouse crowd.
You know as well as I do, that when the police come to your house, for any reason, two things will happen: 1. They shoot the family dog. 2. Absent the family dog, they shoot you. One way or the other, someone or something is going to get shot. no dogs to shoot, no people to shoot, what is a poor trigger happy police officer to do?
