Robert Mueller, the special counsel appointed to look into Russian influence in the 2016 election, is an honorable man. He is — or at least was — highly regarded. He was once known for being above the fray. But as Americans are learning, past performance is no guarantee of future performance. Mr. Mueller, so well known as an honorable man, is now being condemned by some as being, if not thoroughly partisan, at least negligent in giving the appearance of impartiality. His critics have a legitimate gripe.

There is much more evidence to investigate Mueller for corruption as Special Prosecutor than there is to investigate Trump for collusion with the Russians.

Mueller is investigating things that have nothing to do with the election. For example, he is investigating Trump’s 2008 sale of a Palm Beach mansion - a mansion sold to a Russian.

Rosenstein’s order authorizing the Special Counsel, Order 3915-2017, is clear:

“The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Comey in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017...”

Comey in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017 said:

“I have been authorized by the Department of Justice to confirm that the FBI, as part of our counterintelligence mission, is investigating the Russian government’s efforts to interfere in the 2016 presidential election and that includes investigating the nature of any links between individuals associated with the Trump campaign and the Russian government and whether there was any coordination between the campaign and Russia’s efforts.”

Comey’s March 20 testimony creates this investigative structure:

  • Russian government’s efforts to interfere in the 2016 presidential election
    1. nature of any links between individuals associated with the Trump campaign and the Russian government
    2. any coordination between the campaign and Russia’s efforts.

The “nature of any links between individuals and Russia” is subordinate or secondary to investigating Russian government’s efforts to interfere in the 2016 presidential election.

The target of Mueller’s investigation is supposed to be the campaign. A real estate sale a decade ago is not connected with the election.

Rosenstein’s authorization to Mueller (Order 3915-2017) cites Comey’s testimony:

“The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James 8. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017”

Comey clearly stated that the investigation is “part of our counterintelligence mission”:

“I have been authorized by the Department of Justice to confirm that the FBI, as part of our counterintelligence mission, is investigating the Russian government’s efforts to interfere in the 2016 presidential election...”

Rosenstein’s authorization to Mueller (Order 3915-2017) violates 28 CFR 600.1 which requires that the DOJ transfer a criminal investigation. Special Counsel has no place in a counterintelligence mission.

Rosenstein improperly transferred a counterintelligence investigation to a special counsel.

Mueller has not confined his investigation to the scope specified in Rosenstein’s improper order.

Rep. Trent Franks (R-Ariz.) told PJM that recently appointed special counsel Robert Mueller should “recuse himself” from the Russia probe due to his personal friendship with former FBI Director James Comey.

Comey’s congressional testimony about the FBI investigation into possible collusion between Russian officials and the Trump campaign was reportedly postponed so he could speak with Mueller in advance. Franks called the delay “collusion.”

Good post, but I would caution against drawing any conclusions based on information that has not been corroborated by multiple sources. For example, the item about Mueller allegedly investigating a 2008 real estate deal has all the attributes of a fake news story put out there by that same old “source close to the investigation” who can be found behind every bullish!t story that has been covered by the New York Times and CNN over the last six months.

Those aren’t corroborated by multiple sources. They’re two different media reports — with no actual sources identified — about the same topic.

Mueller is an honorable man. However, those photos of him with that short fat little Mexican boy could be embarrassing. Maxine Waters - “The President has put in place an organization with the kind of database that no one has ever seen before in life. That’s going to be very, very powerful.”

The U.S Special Counsel says they’re “following the money”, requesting records from banks and foreign lenders.

One of the focal points: the 2008 purchase of President Trump’s former home on Palm Beach by a Russian Oligarch.

According to Bloomberg, President Trump’s attorney says, “Those transactions are in my view well beyond the mandate of the Special counsel; are unrelated to the election of 2016 or any alleged collusion between the Trump campaign and Russia and most importantly, are well beyond any Statute of Limitation imposed by the United States Code”.

Wasn’t Mueller the FBI Director who took orders from the WH saying an anthrax case was not terrorist when it really was? There was more to it but I can’t recall.

I need some of you young folks with good memories to come up with the case.

“The fact is that the president is concerned about conflicts that exist within the special counsel’s office and any changes in the scope of the investigation,” Sekulow said. “The scope is going to have to stay within his mandate. If there’s drifting, we’re going to object.”

Sekulow cited Bloomberg News reports that Mueller is scrutinizing some of Trump’s business dealings, including with a Russian oligarch who purchased a Palm Beach mansion from Trump for $95 million in 2008.

“They’re talking about real estate transactions in Palm Beach several years ago,” Sekulow said. “In our view, this is far outside the scope of a legitimate investigation.”
