When I was in high school back in the 60's I was taught that a sitting president could possibly be indicted BUT the indictment must be sealed and remain top secret and should be considered a national secret UNTIL that president left his/her elected post upon which time the indicted would then be unsealed and s/he could be possibly prosecuted.

However I was also taught that prosecution under this scenario is merely speculation and has never been done in our nations history. It is uncharted territory for the lack of a better word.

The same sort of law existed in ancient Rome. It's one of the elements that helped destroy the republic. Opponents would charge their political enemies with crimes knowing they would be prosecuted upon leaving office.
