Ruling applies nationwide and means grandparents, grandchildren, aunts, uncles and cousins are no longer subject to the ban

WASHINGTON—A Hawaii judge late Thursday ordered a nationwide loosening of President Donald Trump’s temporary ban on U.S. entry for some travelers from six Muslim-majority countries, ruling the administration’s strict approach contradicted a recent Supreme Court ruling.

““And just so there’s not BS about the anti-Mormon comments, I’m a Mormon, though I am ashamed to admit it.”
“I know how you feel. I’m Jewish.””

I’m Christian and I really don’t feel ashamed about that, at all. Not sure why one would be ashamed of their own faith. Sure there are bad people in every faith, but God ain’t bad. And either is believing in the good things that is taught to us.

It’s not Trump that has caused the vacancies of judges.

It’s the Sen. Democrats that are slow-walking the process. I read here earlier that they had refused to advance around 80-90% of Trump’s judge nominees. Seems they think that personal comments made years ago are justification for the turn downs.

Trump did get 4 more approved Thursday, I think.

Hawaii judge allows grandparents and others to bypass travel ban - Politco

Includes a link to the opinion and order.

From the article ...

"Common sense, for instance, dictates that close family members be defined to include grandparents," he wrote. "Indeed, grandparents are the epitome of close family members. The Government's definition excludes them. That simply cannot be."

The federal judge added that a refugee with a commitment from a resettlement agency met the standard for a "bona fide" relationship spelled out in the Supreme Court order.

"It is formal, it is a documented contract, it is binding, it triggers responsibilities and obligations, including compensation, it is issued specific to an individual refugee only when that refugee has been approved for entry by the Department of Homeland Security, and it is issued in the ordinary course, and historically has been for decades," he wrote.

"Bona fide does not get any more bona fide than that."

-- Does anyone know if trump can take this back to the SC and get a quick ruling on it? --

The regular process would have this decision appealed to the 9th Circuit. But, because the most recent decision is an interpretation of an order of the Supreme Court, it would be reasonable to bypass the usual process and appeal directly to the court that issued the order in the first place, the Supreme Court.

In this instance, the Supreme Court can't claim that the defendant has to get his appeal heard by the Circuit Court of Appeals, while SCOTUS is able to decline to head the results of that - no matter what, SCOTUS will hear the results of the appeal, and the District Court ruling is on a SCOTUS order, not on a 9th Circuit order.

Charter some 747’s and load them full of a few thousand Somalis and Iraq’s worst. Land in Honolulu and get the wheels back up in a hurry. Enjoy.

Be a shame if that judge was put into the category of “enemy combatant” and drone struck.

Making Hawaii absorb a few thousand illiterate unemployable Moslems will solve the judge’s smarmy attitude. To fix obamacare just force the political class to be on it. You’ll have a bill on the president’s desk in ten seconds.

IGNORE this presumptuous attempter of extraconstitutional usurpation of the commander in chief’s prerogatives.

Hope this goes to 9th circuit and supreme court immediately. Judge should be asked to resign, else congress should impeach him.

How is the judge gonna enforce this? The best thing is to vote the law in that allows citizens harmed by illegal interloper to sue state and federal officials personally and the agencies they represent. The feds can sue them for denying their citizens of their civil right for protection. Remove the judges from bench as legally incompetent.

“Agree with your shame. You are in a cult.”

I think you misinterpreted what I said. I have just never bothered to have my name removed from their records. I quit darkening their doors as soon as I was no longer living at home. My only point in saying anything was my derision of the three Mormon Senators on the list. Mormons, like the Catholics, want open borders because Mormons are the second biggest church in Mexico and they want to be able to bring their converts here without government interference. And FWIW, Mormonism isn’t any bigger “cult” that the rest of the “organized religions” in my view, because virtually all of them see themselves as being about our nation’s laws, and for the fact that they hurt people, rather than help them.

“Ted Cruz (TX) toss the baby out with the bathwater”

Cruz is a conservative. We are not going to get rid of one of our few good legislators to placate the bruised egos of those who didn’t like how close he came to beating Trump in the primaries.

Trump buried the hatchet. So should you. Don’t be a sore winner.
