Former Supreme Court Justice John Paul Stevens criticized President Donald Trump’s public commentary on the travel ban litigation in an interview this week, and expressed skepticism about its legality.
Stevens, who retired in 2010 and was succeeded by Justice Elena Kagan, gave an interview to Law360, in which he said the president’s tweets and public statements about the ongoing travel ban litigation is harmful to the courts.
“Of course the Court has to consider the national security issues, but I don’t see the argument finding the danger to our security by allowing Muslims into the country,” he said. “It doesn’t seem to me that’s a very good test of how dangerous the immigrants are.”

And there we have a perfect display of the total lack of understanding by a leftist former justice of the proper role of the Supreme Court. All that the court should be concerning itself with is determining whether the President has the constitutional authority (which of course he does) to determine who enters the country, for national security reasons. Instead, Stevens is pontificating about his determination of the wisdom or potential effectiveness of the policy. That is explicitly none of his, or the court’s business, period.
Gerald Ford (a very happy golf partner of Tip O’Neill) appointed Stevens over the strident objections of conservatives. Ford didn’t give a damn what we thought and he paid the price. Witness the difference in turnout and respect for President Reagan’s funeral versus that of Ford.

I wish it was a mooselimb ban. And, it is not just the terrorism that is caused by them. It is the other crime, the welfare, the lack of compatible values, and that they have no wish to be American and will always further mooselimb domination goals first and foremost.
But had no problem when Obama publicly chastised the court in the state of the union or put pressure on the Chief Justice to change his vote on Obamacare.

And in any case, Islam is not American in any way. And we should not allow people from Islamic areas of the world to immigrate. They have no place here. Between Bush and Obama, we already have nearly 2 million since 9/11.

What the good Justice fails to consider is that the Federal Courts have no input into what constitutes a National Security risk...nor any role in its mitigation.
