It is a bureaucratic rule rather than EO. Process decision. Trump should issue EO suspending rule. That is legal.

“Rules” passed by the EPA have the effect of laws. You can go to prison for violations. Congress surrendered its law making power to the EPA. Thus, the executive order was turned into a law, or so I’d argue if I were on their side. Also, this is as political as the lower court judges blocking the travel ban. I think it will be overturned. In the meantime, all the EPA has to do is let it be known they are suspending enforcement.

You made an excellent point, and it is a prime reason why I believe that the ruling will be over turned in President Trumps favor.

Doesn’t that just fry you? The courts won’t ever stop the constant expansion of regulatory power be the illegal fourth branch. But they will immediately stop any effort to slow or reverse that expansion. Grrr...I’m so furious I could spit nails. Everywhere you look the GD government has metastasized into a monstrous tumor intent on eating away everything in the country.
