A federal judge ordered Homeland Security Monday to reinstate an amnesty for a Dreamer and blasted the government for “running roughshod” over a young woman in a ruling that breaks new ground in legal rights for illegal immigrants.
Judge Mark H. Cohen ruled that the department didn’t follow its own procedures when it stripped Jessica Colotl of her status under President Obama’s 2012 amnesty, known in government-speak as DACA.
The judge ordered her deportation amnesty and her work permit be kept in place, and sent U.S. Citizenship and Immigration Services — the Homeland Security agency that handles applications — back to consider Ms. Colotl’s case again.
“The public has an interest in government agencies being required to comply with their own written guidelines instead of engaging in arbitrary decision making,” Judge Cohen said.
When the Obama administration established the program it said DACA was entirely at the discretion of Homeland Security, and could be revoked.

Paroles can be revoked and that's all that's happened.
Looks like those who were approved for DACA now have a right to stay here.
Question is : why is the government still approving MORE of them for DACA?
We aren’t voting our way out of this mess.
A judge can’t compel one president to obey a former president’s executive order. DHS MUST ignore him, or further cede Article II Executive power to the judiciary, a major breach of oath.
Maybe what is needed more is picking up judges who work against America. Judicial supremacy over the other branches needs to be stopped.
DACA has no legal basis.
It must be ended if we are to restore the rule of law.
Allowing it to continue gives judges an excuse to make rulings like this.
What EO has been erased?
President Trump has not rescinded DACA.
He should have.
Ask the judge what legal authority he has to try and reinstate an erased EO?
So far they seem to be proving you wrong.
President Trump is continuing the illegal DACA program as if it were law and not something dreamed up by Obama.
He promised to eliminate this and did not.
This ruling is a result of that.
DACA was not rescinded as promised.
It is still in effect because President Trump did not keep his promise to stop it.
Wouldnt a judge just rule such an order as unconstitutional as with the Muslim country travel ban?
Obama issues edict.
Trump and company cancel the edict.
Judge says Trump should follow policy, but makes no mention of Obama not following policy.

Amazing how Due Process makes a comeback when a Democrat is not in office. I'm all for the young lady having the right to bring her argument into a fair court... and I'm almost shocked that the WaPost would write something so honest and Constitutionally proper as "if not an outcome"... and now I see that it was the WA Times, not the WA post, LOL. My worldview hath been restored. ;)

Easy solution: Rewrite the procedures.
1. Are you illegal?
-Yes? Your amnesty is revoked and you will be deported.
-No? Then why are you bothering DHS when they are busy deporting criminals?
