Do you use any social media? I’m sure the court’s reasoning is not limited to Facebook.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
We both use F.R. and are not really “hidden” behind our screen names.
Sorry, but that is a clear violation of the Fourth Amendment.
The internet is a public owned resource built and maintained using imminent domain. Like the public road system
I am sorry but this assertion is incorrect.
The internet is composed of ISPs (Internet Service Provider) some of whom are private companies and others are public traded companies. This collection of companies has agreed to use THEIR PRIVATE NETWORKS and exchange traffic between ISPs using commonly agreed to protocols for communications.
However, I do agree with your second assertion. If you want to keep things private, don't publish the information to the public via Facebook.
A “bulk-search warrant” sounds like a general warrant, which the Fourth Amendment is meant to prohibit.
It kinda sounds like it, but it may not be the same. If they are bringing charges against 75 people, individually, but use a “bulk search warrant” that is limited to those 75 people, it sounds like it is just being more efficient. Kinda like a class action lawsuit in reverse.
“Hey judge, don’t let police look at the things these people posted on Facebook for everyone to see!”
I’ve set my privacy so that, in theory, only my friends can see my stuff. I know that only works if none of my friends share it, etc., but still, the intent is clear. i.e. my intent is not to share it on facebook so “everyone” can see.
Reminds me of the time I was stopped for speeding a litle before July 4th in 1975 in my Opel GT. The car only has a hole in the dashboard instead of a glove box. It had a 144 bottle rocket pack sticking out of it that I got off the indian reservation because, technically, in Washington state they are illegal.
So the cop took them and then asked what was in the brown paper bag slightly sticking out from under my seat.
That had a lid in it. Cost $150 at the jail to prevent my going it. Fingerprinted and everything.
Kids, if you are doing something illegal, be careful. Duh.
Note: I’ve not touched the evil herb since 1976.
Don’t think for a minute he doesn’t use FB to help build his case. And lots of hours sitting in his van with a camera.
Youtube has tons of “insurance fraud” videos. The dash cam ones are my favorite. :-)
The one where the cameras show the guy buying a hot dog in Wal mart, then another camera shows him placing it on the floor in an aisle, followed by his GF stepping on it and gently lowering herself to the floor, followed by an attempt at an injury lawsuit is a hoot.
It depends on whether the posting is public or not or if it is a message between restricted individuals. I don”t believe the Court knows how facebook works.
