Many elderly folks (and some of us younger) have hearing loss, and who knows what the visibility was at the time. Everyone is guilty of inattention at times, and funerals emotionally drain people—at least those with feelings, some of whom still inhabit FR.

God comfort this family and welcome the woman into your arms.

That was already established. It’s why you don’t assume that speeding driver coming at you sees you or will stop. You can be 100% in the right legally, even in a crosswalk, but you’ll dead right. Some folks here can’t quite grasp these basic common sense facts. Very odd.

Regardless, the driver was not paying attention so it’s obvious the woman crossing the highway wasn’t either, and or, simply assumed the driver saw her and would stop. Big mistake. The only scenario left would be she committed suicide by intentionally walking into the path of a vehicle, which is probably unlikely.

What makes you think they were in a crosswalk or stepped out in front of traffic ?
It appears pretty simple to me from what the article said. What do you bet that she was texting on a cell phone ?
It was well past sunrise.
What was the speed limit where she was struck on Highway 43 ?
We all can safely assume it was an accident and, instead of hitting the brake pedal, she hit the gas pedal.

Now that being said, I'm not for more regulation, or for more severe penalties.
This teenager has got to live from now on, with the death of that woman on her conscience.
But, plain and simple, she's the guilty one, and not the victim.

After finding another article on the accident and the funeral they were attending of 93-year-old Paul Owensby.
Visitation was held at Linden United Methodist Church on, March 23, 2017 from 9:30 a.m. until the 11:00 a.m. located on the east side of Highway 43, also known as MAIN STREET, in the center of downtown Linden, AL.
Burial of Paul Owensbywas at Linden Memorial Park in Linden, Ala.
I checked the maps, and that graveyard is on Highway 28, and not on Highway 43, so the accident happened at the downtown Church as the 'Visitation Service' was ending.

Therefore the speed limit was probably 35 MPH or less, at the scene of the accident .

You could have saved some time if you read carefully. Crosswalk was an example of being 100% in the right, with the light on your side, in crosswalk and you can still be killed instantly if you’re not paying attention. I’ve mentioned this several times here. It’s why one cannot simply assume the driver of a vehicle sees you and will stop.

Lots of people are in the right, but dead right.

I read that thanks. And it really don’t matter the venue, same goes in parking lots.

In fact, 35mph can kill you dead very quickly. In LA and elsewhere, people get killed in park lots. Ya gotta be careful and pay attention. Never assume that driver sees you and is going to stop. It’s basic common sense.

Btw, it’s okay to speculate, but I don’t safely assume anything until all the facts are in or reported. And most vehicle collisions are certainly not, “Accidents” but are caused by recklessness or negligence, which falls under simply not paying attention. It’s why our courts are full of people seeking relief for damages/losses.
