House Judiciary Chairman Bob Goodlatte is blaming the Obama administration's "lax immigration policies" for the rape of a 14-year-old girl at a high school outside Washington last week.
The Virginia Republican made the accusation in a letter to Homeland Security Sec. John Kelly on Wednesday.
"Once again, we have an example of how the Obama administration's lax immigration enforcement policies resulted in a life being seriously harmed in this case, the life of an innocent 14 year-old-girl who was simply attending school," Goodlatte wrote. "There is no doubt that such heinous crimes by illegal immigrants who were encountered by the Obama administration, not removed by the Obama administration, and instead actually set free in American communities by the Obama Administration, will continue to occur until sufficient enforcement has occurred."
A 14-year-old female student at Rockville High School in Maryland reported being raped by two male students in a bathroom last Thursday. Following the incident, the girl ran to school administrators and reported the attack. Police were called to the school and arrested the two suspects, 17-year-old Jose Montano and 18-year-old Henry Sanchez-Milian, at the school. They both face charges of first-degree rape and two counts of first-degree sexual offenses. A judge on Friday ordered both held without bond due to public danger as well as flight risk, because both immigrated to the U.S. months ago.
During the initial court hearing, it was revealed that Montano had arrived in the U.S. from El Salvador and Sanchez-Milian was apprehended entering the country from Guatemala seven months earlier. U.S. Immigration and Customs Enforcement had issued Sanchez-Milian a notice to appear in court for an immigration trial to see if he would be permitted to remain in the country. However, no court date was set due to a massive national backlog in immigration cases.
"Perhaps if Sanchez-Milian had known he would likely be deported, he would not have come to the U.S. and the 14-year-old high school student would not have been assaulted," Goodlatte said, referring to executive actions that President Trump has taken to uphold all immigration laws.
In addition, Goodlatte asked for all immigration and legal documents related to both suspects, including when the dates they interacted with law enforcement and if they were previously removed.
Sanchez is due in court April 14 and Montano is set to go before a judge March 31.
