In a bill aimed at securing a "right to be forgotten," introduced by Assemblyman David I. Weprin and (as Senate Bill 4561 by state Sen. Tony Avella), liberal New York politicians would require people to remove inaccurate, irrelevant, inadequate or excessive statements about others...
Within 30 days of a request from an individual,
all search engines and online speakers] shall remove content about such individual, and links or indexes to any of the same, that is inaccurate, irrelevant, inadequate or excessive,
and without replacing such removed content with any disclaimer [or] takedown notice.
[I]naccurate, irrelevant, inadequate, or excessive shall mean content,
which after a significant lapse in time from its first publication,
is no longer material to current public debate or discourse,
especially when considered in light of the financial, reputational and/or demonstrable other harm that the information is causing to the requesters professional, financial, reputational or other interest,
with the exception of content related to convicted felonies, legal matters relating to violence, or a matter that is of significant current public interest, and as to which the requesters role with regard to the matter is central and substantial.
Failure to comply would make the search engines or speakers liable for, at least, statutory damages of $250/day plus attorney fees.
you assuming either of these asshats has read the Constitution, I will make wild guess that neither has ever read or been near a copy of the document
Even aside from its offensiveness to the First Amendment, enforcing this law would be a massive enterprise, literally impossible. A single site like Breitbart receives more than 10,000 comments every day. Who is going to review even that one site and determine which comments (or entire stories) are inaccurate, inadequate, irrelevant, or excessive?
Quite right. As in photoshopping out the images of political opponents, done in such a crude manner as to demonstrate one's power. I.e., we will tell you who and what to forget and there isn't anything you can do about it.
Regarding “irrelevant” news or comments: things go in and out of relevance, depending on current events. It is difficult or even impossible to determine when something has become permanently “irrelevant.”
They can do this; just amend the Constitution federally or state charter at the state level. Otherwise, shut up or go to jail as an enemy of the foundational law.
sorry- should have said ‘next casualty’
[[But the deeper problem with the bill is simply that it aims to censor what people say, under a broad, vague test based on what the government thinks the public should or shouldnt be discussing.]]
Exactly and the very reason it is unconstitutional and the reason why free speech is protected (Except in very specific cases) is that the potential for abuse and non stop litigation as groups become professional complainers and both sides of the isle go tit for tat ‘reporting “Offensive” speech’ that they don’t like
[[ the power to force people (on pain of financial ruin)]]
Exactly what has happened in the case of Christian bakers, florists, photographers who refused to cater to gay marriages on religious grounds-
Are you prepared to SHOOT AND KILL those would enforce such a dictat—BECAUSE IT’S COMING!
Lock and load, boys and girls.
Excellent quote. Let’s all spell 1984 together.
At that point I think we would rather kill ya then live with ya.
Exactly! That's why I'm in favor of:
1. All Congressmen must work from their districts.
2. Congress shall meet for two months a year only.
Our Congresscritters will then have lots of time to do what we elected them to do: Represent us.
Amen
With modern conferencing and other technology, there is no need for 100 Senators or 435 Representatives, their staff, Capital police, etc., to live and work in the Washington, DC, area. Keep the Capitol for a few ceremonies, and convert it into a museum. Let the perfumed princes and princesses live in their home districts or states.
Mark
I will not comply.
Sad. But true.
BTTT!
Amen to you Wallace. BUMP!
