Four more states to challenge Trump travel ban

Democratic attorneys general in four states announced on Thursday that they will try to block President Donald Trump’s revised executive order on travel in court, The Hill reported.

Washington Attorney General Bob Ferguson said Thursday his office will file a motion asking U.S. District Judge James Robart, who issued the order blocking the first version of the ban, to reaffirm that the order applies to the new version of the travel ban as well.

The new ban, which was signed by Trump on Monday, blocks citizens of six Muslim-majority countries: Iran, Libya, Somalia, Sudan, Syria and Yemen. Iraqi citizens, covered by the initial ban, will be allowed to travel to the United States under the new order.

The order is temporary, until proper vetting procedures – a central campaign promise of Trump’s – can be implemented.

New York Attorney General Eric Schneiderman, Oregon Attorney General Ellen Rosenblum and Massachusetts Attorney General Maura Healey said they would join Washington in challenging the new ban.

“President Trump’s latest executive order is a Muslim ban by another name, imposing policies and protocols that once again violate the Equal Protection Clause and Establishment Clause of the United States Constitution,” Schneiderman said in a statement quoted by The Hill.

Earlier this week, the state of Hawaii challenged the new travel ban in court, arguing it would hurt Hawaii’s tourism industry and its businesses, along with Hawaii educational institutions.

Asked about Hawaii’s lawsuit, White House press secretary Sean Spicer said Thursday the administration remains hopeful that its new ban will survive court scrutiny.

Hoping the less nutso 2nd Circuit will note that 1. States have no standing to contest federal immigration policy, and 2. Immigration is not a right, and 3. the 14th Amendment equal protection clause is not absolute but can be mitigated by compelling state interests, such as keeping terrorists from entering the country. The 2nd Circuit (NY and MA) is left wing, too. But not a hopeless haven for insane jurisprudence and jurists, as the 9th Circus has been and is.

Great. Let those states take them and keep them. Sue the states if any refugee crosses a state line into a real State.

If some leftist activist sitting on a bench wants to enter another restraining order/injunction interfering with the clear exercise of executive power over immigration, the next step for the administration is to announce it is going to completely ignore the court’s order.

The judiciary in this country is completely out of control and has become a serious threat to freedom and liberty.

Leftist judicial activism-this is where we must draw swords.

I heard Law Professor John Eastman recently say that Congress Has already forbid the inferior courts from hearing immigration cases, Wish I knew where to find that statute.

All such filings should be ignored, and any rulings from Federal judges on this matter should be ignored as well.

This is a matter of separation of powers and the judiciary has no say in the matter.

A Federal judge cannot be allowed to hold the President and the security of the nation hostage, nor can the judgment of a Federal judge be substituted for that of the POTUS, in a matter that clearly is the responsibility of the POTUS under the Constitution.

I remember that Arizona tried to mess with Federal Immigration Enforcement and the Supreme Court shot it down. But now its different?

The big problem is we still are having to contend with the filibuster. Nuke the Filibuster then start passing laws against these rogue courts and judges, either eliminating them or creating additional seats to be filled by Trump in them or creating a Higher Supreme Court. Call it the Super Supreme Court.

NUKE THE FILIBUSTER.

Back when the states wanted to refuse to give foodstamps, medicare and welfare to illegal immigrants, the federal courts said they cannot interfere in immigration, a federal issue, and they had better shut up and pay. Back when Elian Gonzalez was deported, they said immigration was the federal government’s exclusive bailiwick. Now apparently it’s a state’s rights issue?
