An FBI director serves a 10-year term and can only be dismissed for committing a crime or serious misconduct. President Obama or Hillary Clinton or Donald Trump could not remove Comey because they disagree with him, but they could make his life miserable.
He can be dismissed but no cause is needed. He is allowed one term of no more than 10 years, but it is not a “term”. It is a -maximum limit- designed to prevent a future J. Edgar staying for life.
But he is not granted a term under law. He can be fired at will. But 10 years is the max he can serve.
According to a 2014 report by the Congressional Research Service, there are no statutory conditions on the Presidents authority to remove the FBI Director. In other words, the President can indeed fire the FBI director. An FBI director can also be removed by congress, through the impeachment process.
They can be fired like any other minor Bureau leader. He isn’t even cabinet level and they can be fired at will.
Well, I didn’t know that he could only be dismissed under the circumstances you describe. I thought he was like every other political appointeee...that he served at the pleasure of, and could be dumped when a new administration came into office. Thanks for the info.
