You are wrong on at least two counts. First, under the law of agency, if it was done by his minions it was done by him. That is why Nixon was in trouble for the Watergate bag job. And then there is the public relations aspect.

Trump is careless with words. It is extremely annoying, as he is so close, then the media & DC gets fixated on his words and the point gets lost. They spied on the opposition, during the campaign, apparently for no good reason. Instead, it will become “Trump attacks Obama...”
