Idaho woman issued federal citation for not standing for jury in....(OREGON STANDOFF)

Iva Henderson, at age 59, had never been on an airplane before she was subpoenaed to testify in federal court in Portland this week.

Henderson and her husband, Rich Henderon, live in a small rural community in Riggins, Idaho, population 600. Both had spent two nights at the Malheur National Wildlife Refuge last winter. They said they'd gone there to protest what they viewed as the unjust federal prosecution of two Harney County ranchers......

Wednesday afternoon, though, she was told she wouldn't be called to testify at all. A witness coordinator told her a flight would be arranged for her return home . In the meantime, she was invited to sit in the courtroom and listen to the trial.

As the jury was called in Thursday, the judge asked everyone to stand, the usual procedure in federal courtrooms. Henderson remained seated in the front row of the courtrooms. Henderson remained seated in the front row of the courtroom gallery. A deputy U.S. marshal asked her to stand. Henderson didn't. The proceeding continued.

After a break in testimony and the jury was called back in again, the deputy marshal again told Henderson to stand.

The petite gray-haired woman remained in her seat.

"It's against my beliefs," she told them.

He directed her to leave the courtroom if she didn't stand. So Henderson stood up and left and the deputy marshal followed her out.

Henderson said she was led down to the first floor of the courthouse by Federal Protective Services officers. There, she received a citation for failing to comply with courthouse signs. She was ordered to return to court in May or face an $80 fine......

Henderson said she's not sure if she'll pay the fine. But one thing she does know--"I'm not coming to Portland ever again," she said.....

A 'sidebar story' from the second Oregon Standoff trial.

Judge Anna Brown threw out a lot of potential defense witnesses this week leaving folks like Iva Anderson 'in the lurch'.

And she ends up 'sitting down for her convictions'.

And another act of intimidation aimed at people who support the defendants in the Oregon Standoff trials.

A federal marshal confronted activist Kelli Stewart at the first trial over her online posting about the trial.

At least they didn't take her down and taze her like defense lawyer Marcus Mumford at the end of the first trial.

Mumford's trial for 'resisting' is set for next month in Portland.

The four defendants in this rigged trial, with the judge getting to slap them guilty on misdemeanors even if the jury acquits them on the felonies, will see their defense lawyers wrap up their case on Monday.

Good point. I’ve been in court in a jury pool and for other legitimate reasons, and do not understand the need for the “stand” protocol when the judge enters and leaves. If you want my respect, earn it. It doesn’t automatically flow from your job title.

Lady got a flight to Portland and a few days vacation, and it only cost her $80.

In the military, you salute the uniform, not the officer.

In court, you stand for the robes, not the person in them.

Since she’s indicated that she may not pay, it sounds like she may want to be housed a month or two at taxpayer expense.

Excellent analogy!

Rule of Law is predicated on respect for the Institutions and the Laws. The individuals occupying various positions are not necessarily deserving of respect, as individuals.

If they are corrupt, then the system needs to remove them, swiftly and publicly and with penalty.

If respect for the Institutions and Laws is lost, then we move further down the road toward anarchy. This is the danger of the Occupy, BLM and EnviroWhacko protests not being treated as Civil disorder. In a much less serious example, a 55mph speed limit on roads designed for 70+ with median traffic moving at 75-80 only creates either disregard for the law or even contempt.

In this case, respect is not deserved. The activist judge overruled the plain language of the U.S. Constitution and stated she, and not a jury, will decide the misdemeanor charges. I might have remained sitting as well had I attended.

You might try reading the excerpt at the top of the page. You said,

The story makes clear that the defendants are getting a jury trial:

As the jury was called in Thursday

Or are you referring to the contempt citation, and you are merely ignorant of the law and don't know the difference between civil contempt and criminal contempt?
