This evening the Supreme Court asked both sides in Gloucester County School Board v. G.G., a challenge to a Virginia school boards bathroom policy, to submit letters to the court discussing how the case should proceed in light of yesterdays revocation of the Obama administrations prior guidance. In that guidance, the federal government had interpreted a 1975 regulation to require schools to treat transgender students consistent with their gender identity. The U.S. Court of Appeals for the 4th Circuit had relied heavily on the now-revoked guidance in striking down the school boards policy, which instead required students to use the bathroom that corresponds with the sex that they were assigned at birth.
Both the school board and G.G. the plaintiff in the case, who identifies as a boy and wants to be allowed to use the boys bathroom had previously advised the court that the case should still proceed even if the Obama administrations guidance were withdrawn. Even without the guidance, they contended, the justices could and should decide whether the boards policy violates Title IX, a federal civil rights law that bars discrimination in education. Todays request, which appears as an entry in the courts docket for the case, suggests that the court would like to hear more about that argument and why, in the parties view, the case should still go forward even now that the guidance at the heart of the 4th Circuits ruling is no longer valid.
The deadline for the board and G.G. to file their letters is 2 p.m. next Wednesday, March 1. The case has been scheduled for oral argument on Tuesday, March 28.
If you have a dick, you can’t go into the girls bathroom.
Not that difficult people.
This is almost becoming laughable if it weren’t so sad. God created male and female. . .no in-between there.
I hope someone tells that court to —— off!
Courts don’t make law. They enforce it.
Have any laws been passed by Congress that covered this issue? Has the president signed off?
Sorry court, you have nothing to say about it.
This goes to them, it will be law of the land.
Okay. I’ll “weigh in.” Boys use the boys room and girls use the girls room. For those suffering from sexual disorientation, see the school nurse to find out which set of genitals you have.
I’ve read it twice and l cannot decide if this is good or bad news. My guess is that it’s bad especially with a “4-4” court. Especially when one of the 4 we need is Kennedy who tossed hundreds of years of cultural standards out the window with Gay “marriage”. We’ll be lucky if states are “allowed” to keep to keep boys and young men out of the girls bathrooms, locker rooms and showers. I can’t believe l just typed that sentence. It’s a nightmare. Obama you evil bastard may you burn in hell.
Seems like the 4th Circuit needs an enema - maybe after the 9th.
Prepare yourselves, unelected lawyer gods are about to legislate from the bench.
The funny part about this is that if one of these people was to just go to into the restroom, enter a stall, close the door, do his/her business, wash his/her hands, and leave, it would not be that big a deal.
I don't know about females, but in my experience, we males generally don't use waste extraction as a social occasion. We do our business and leave. And, frankly, the most that would happen is "Gawd that is an ugly girl / that is a delicate looking boy..."
But Susie can't just be satisfied being "Susie." Susie has to let EVERYBODY know that she is Susie who used to be Justin last year.
And you'd better danged well pat her on the back each and every day, congratulating her on her bravery, or she'll make destruction of your life as her highest priority.
And that's the biggest problem with this whole mess.
IMHO
[NB: I use the gender pronoun used because that's how it would be treated in public, not that I personally agree]
It’s not just the bathrooms it’s the locker rooms and showers, big difference.
Get rid of all gender based rest facilities. Then bring in 10 or 20 porta potties. 1 seat, 1 customer. There’s also enough room to change your clothes so we won’t need to worry about locker rooms. Just put a package of wet wipes in there to replace the showers.
Are the “rights” of confused weirdos with improperly wired brains more important than the rights of normal people?
>Are the rights of confused weirdos with improperly wired brains more important than the rights of normal people?
No, it’s just a way for the left to humiliate normal people.
What if they relabeled the bathrooms?
Instead of boys/girls or men/women, change them to XX and XY with a sign that says (feel free to ask if you don’t know).
Or go really blunt and label them interior plumbing and exterior plumbing. Or perhaps “pee and wipe” on one door and “pee and shake” on the other.
Or maybe “pee-pee” on one door and “woo-woo” on the other.
I don’t see why the normal should have to give into to the abnormal. I don’t see why females should have to tolerate males, no matter how cut up they are, using their private facilities if they don’t want them to.
Freegards
treat transgender students consistent with their gender identity.
But their gender identity is only in their mind. It is not biological fact. That is called mental illness. You may think that though born a male, you are a female. That is okay, you can do that. But what you think is not part of me. I should not, can not, be forced to play along with your mental illness by the Government.
The precedence is being set by leftist 'officials' re:not going to enforce federal immigration laws. A State wishing to maintain a sense of normalcy should tell the court to piss up a rope. Anyone caught as a male in a female facility, goes to jail.
