The federal appeals court that refused to reinstate President's Donald Trump's travel ban will vote on whether to have a larger panel of judges reconsider the ruling.
The chief judge of the San Francisco-based 9th U.S. Circuit Court of Appeals, Sidney Thomas, announced Friday that one of the court's judges had requested the vote. The judge was not named.
A three-judge panel of the court a day earlier rejected the Trump administration's motion to immediately reinstate the travel ban. The 9th Circuit vote will determine whether an 11-judge panel of the court reconsiders the administration's request.
A majority of the court's 25 active judges would have to vote in favor of rehearing the case. That prospect was not likely. . .

At least one of the Judges has some sanity. Apparently at least.
A threat to them was made yesterday by McCain over a bill to dissolve that particular circus court..maybe they got the memo!!! And are worried!
The administration isn’t contesting the ruling. could it be the 9th is concerned about being outmaneuvered by Trump the chess player? Or are they concerned Sessons will split the 9th into 2 smaller districts and load it with conservative judges?

I think they realized they screwed up and are using this as an excuse to get out of the public eye.

The 9th Circus just realized they won a battle and lost the war. The calls to split them will be deafening.
Donald, Pull the Executive Order. Don’t give these clowns a chance to either redeem themselves or make bigger fools of themselves.
Just issue a new executive order and if some rogue court issues a stay, ignore it.
The courts HAVE NO JURISDICTION to stay your orders.
NONE.
Any order they issue is VOID!
No one is obligated to obey an unlawful court order. In fact, have the Marshall’s office arrest the judge for sedition.

The 9th Circuit has 11 judges. Usually only 3, chosen at random, hear a case (very busy district). Some cases are important enough that when appealed, instead of going to the Supreme Court it is first re-heard by all 11 judges.

Whatever. The blowback on the liberal apparatchiks is going to be tsunami-like. They thought Trump was a shocker. He is the tip of the spear, for sure.
Americans are SICK of the elites on BOTH SIDES OF THE AISLE living high and telling the populace to learn their place.

A chance for the Ninth Circuit judges to unite, cover one another’s back, and give a group finger to Trump?

They are afraid that their national laughing-stock status just increased exponentially, that their district will be eliminated, and then recreated elsewhere, or that Trump will re-word his ‘Proclamation’ in accordance with Title 8, section 1182 in a verbatim-like manner that further exposes the court as a bunch of frauds engaged in legal group-think, or a combination of the three.
In short, they know they’re standing on the President’s penis and they may be looking for a way to step off of it right quick before they get slapped across the face with it.

That's not how judges think...especially Senate-confirmed appellate "Justices".
The en banc hearing request will be denied as a public display of solidarity with the Three Idiots. Or, the ruling will be upheld en banc for the same purpose.
On this case the 9th Circus should be shunned. No additional briefs or filings from the Government to this illegitimate "court".
So in other words they’re going to rule on this case again right?..which probably will rule against trump again and side with the three judges! Waste of time and money!
