Justice Dept. lawyers say Trump has power to block foreign visitors

President Trump’s extreme vetting policy is a temporary, legal and smart use of his national security and immigration powers, the Justice Department said in its legal defense, filed Monday evening, that argues the courts are meddling with the separation of powers.

The administration’s lawyers are asking an appeals court to lift a lower judge’s restraining order that has defanged most of Mr. Trump’s Jan. 27 executive order imposing the new vetting policy.

The lawyers said immigration law gives Mr. Trump expansive powers to decide whom to let into the U.S. and whom to block, and said that while people who reach the U.S. do have some rights, those who are applying from overseas have no claims.

They also said the State Department has the power, “at any time,” to revoke visas, and foreigners don’t even have a legal right to go to court.

“Aliens outside the United States have no due process rights with respect to their attempt to gain entry into this country,” the lawyers wrote.

Seems judge Robart and the Ninth Circus Court of Appeals have the leftists and 0bama's lapdogs on their side however the law is not.

Trump may have to eventually disregard these leftist judges who are acting out of activism. To allow them to continue like this gives them credence that they do not have.

The judges said each side would have 30 minutes to present their arguments beginning at 6 p.m. Eastern. It is unclear how soon a ruling could follow. Audio of the hearing will be posted online by the court soon after it ends, the judges said in their order.

Looks like he had a conflict of interest and should not have even ruled on this case. Is he a lawyer? Should be disbarred too.

If Gorsuch isn't confirmed until April or May, these leftist judges will be a big problem for Trump for everything that he does in his first 100 days.

So will Trump put up with this nonsense or will he start disregarding these leftist judges?

I read it from earlier today. He does pro bono work for refugees, maybe supports BLM. Doesn’t seem like a disinterested party to me.

President Trump should ask Congress for a declaration of war against the Islamic State. Then, with that done, take whatever actions necessary to protect the US and carry out that war. Even the 9th Circuit would be hard pressed to not let the executive branch prosecute the war as it sees fit. First by closing our borders to people and countries not aligned with us.
