My guess is it won't get that far. From reading the decision, the judge ruled only that the states (WA and MN) had standing and that irreparable harm would befall them if a stay was not granted and they prevailed in their case.

I think the question of standing is a stretch, and it will be interesting how an appeals court will deal with the conflicting interests of federal over state government. If the state argument were to stand then what happens to states that allow illegals to matriculate?
