Winkler is a Constitutional lawyer.
He is not a fire breathing gun hater. In some ways he is more dangerous. He looks at the Second Amendment, and carefully devises ways to twist and undermine it with subtle arguments.
As an example, when Peruta held that there was a right to bear arms outside the home, that both open and concealed carry could not be banned, Winker opined that California should opt for open carry, and place as many roadblocks as possible in the path of open carry.
His argument was that would be easier to do than to regulate concealed carry, because carriers could be identified more easily, and social pressure brought to bear.
