Made sense for hundreds of years but two things are different now. First, everyone sues everyone all the time, courts are the forum for settling disputes, years ago one couldn’t even claim a cause of action for suits that now, regrettably, carry the day.

More importantly however is that government does EVERYTHING now. Sovereign immunity would never even have risen in the past. No such construct as an EPA would be on a bulldozer breaching a mine and ruining a river. Government wanting to change our diapers doesn’t deserve Sovereign Immunity.

And neither is the EPA. It didn’t exist before 1972. Nixon created it to look into Rachael Carson’s “Silent Spring” allegations about DDT and now it has grown to a commie environmentalist monster and DDT was not the culprit.
