Today, the site is owned by the Maryland-National Capital Park and Planning Commission as a historic site.

That DOES NOT give some self-appointed atheist group the right to alter or destroy a historic site which the Commission is charged with protecting because they find it offensive.

The Cross sits on a very small piece of land surrounded by the intersection of U.S. Route 1, and Bladensburg Road. That intersection has for many decades been known as Peace Cross. See my post below (forget the #). Doubtful it is on private property. Most likely deeded to the National Park Service.
