If somehow, this election flips on the recount, Trump has 5 business to challenge the results. This takes Wisc. passed the 12/19/2016 vote by electors date and they don't want to do that. When you start messing with the deadline, you run into a 14th amendment equal protection issue.

How Does a Candidate or Petitioner Challenge the Results?

The candidate or petitioner has a right to appeal the recount determination in circuit court.

The appeal must be filed with the circuit court within five (5) business days of the completion of the recount in all counties concerned.

Notice must also be served in person or by certified mail on all other candidates and persons who filed a written notice of appearance before the board of canvassers.

If the recount affects a state or federal office or referendum, notice of the appeal must be served on the Wisconsin Elections Commission. See Wis. Stat. §§ 9.01(6), (7), (8), & 9.

I understand your point, but all candidates also have the right to challenge the idea of even performing a recount. He has 7 days to do this and then the Board has 5 days to decide if his objection is sustained or overruled.

Starting the recount before the objection time has passed deprives him of his right to contest not even doing the recount. And this is no small harm. The results of a recount will inevitably leak, especially if it substantially changes the count. This will have an effect on the Board’s decision about the objection (which is different than a post-recount appeal).

Ms. Stein is not discriminated against or losing equal protection if proper procedure is followed. The law was in place before the election and she should have known about the time constraints before she waited too long to make the recount request.

One thing we’ve learned about Trump, he doesn’t broadcast his plans in advance. I have trust in the Trump organization having a well organized monitoring team in place here and ready to take legal action if needed to keep this honest.

I do not believe there can be a “running out of the clock.” Electors have to be certified in time for the electoral college vote. I believe that reason was the reason cited by SCOTUS when bringing an end to the Florida recount.

Why would you expect anything else? Trump doesn’t give away ANYTHING specific to the media about how he is going to deal with any issue. Why would he be any different in this instance? What good would a press conference announcing his legal team to deal with this recount BS?

Perhaps many Freepers would do well to remember, Trump isn’t a politician. He doesn’t announce what he is doing behind the scenes. It’s one of the many reasons he was elected President.

Too much hand-wringing these days AFTER we won. I do not understand how folks can trust Trump to manage the country but not a damn recount we all know isn’t going to move enough to change the final result.
