I will be watching him even as he is escorted off the WH premises.
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by
granting Commissions which shall expire at the End of their next Session. ... The recess appointment power, like
the appointment power (Article II, Section 2, Clause 2), applies to “Officers of the United States.”
I wouldn’t be surprised if they have to drag him out kicking and screaming.
Protocol is he’s at the inauguration. They will just change the locks while he’s gone. /s
Obama will appoint Garland during the Christmas break and the democrat media will cheer and cheer.
He thumbs his nose at Donald before stewing off into the sunset.
He actually seems rather chipper, and he has been somewhat gracious. I suspect a part of him -- and on some days most of him -- is getting a kick out of Hillary faceplanting.
His lies never cease! His last words before passing will ultimately be nothing but another lie. “I see the light”.
You totally nailed it.
A recess appointment of Garland would keep him on the bench for 2 years.
Oh, crap. Is there anything that can be done to forestall this?
That’s OK. He got locked out of the place while he was still POTUS. Not very mechanical I suspect.
Sometimes, especially when both houses of Congress are controlled by a different party than that
of the President and since both Houses must consent to adjourn, the Senate or House leadership will
seek to block any potential recess appointments by not allowing the Senate to adjourn for more than
three days, blocking a longer adjournment that would allow recess appointments to be made. Harry Reid
and the dems did this to GWB during his last two years.
Under Article II, Section 2 of the Constitution: The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.
Courts have interpreted "recess" to mean a ten or longer-day gap between sessions of the Senate. That means Obama, during the recess, could appoint Merrick Garland to the Supreme Court, since by adjourning for the year on December 9, the Senate will be gone for far longer than ten days.
Can Trump lean on them to do this? Or are they going to do the usual RINO surrender monkey act and we have to bite our nails for a month?
