Donald Trump could flip high court on its head

President-elect Donald Trump controls the future of the nation’s highest court, and the billionaire will likely push its ideology in a conservative direction that our nation hasn’t seen in decades.

“Assuming that Donald Trump gets to replace more than one justice, this will be the most conservative Supreme Court we’ve had since 1937,” said Erwin Chemerinsky, dean of the University of California, Irvine School of Law. “There will be a majority to overrule some fairly significant decisions.”

Trump has late Justice Antonin Scalia’s seat to fill, but Justice Ruth Bader Ginsburg, 83, and Justice Stephen G. Breyer, 78, are nearing the end of their careers. Those are two of the more liberal justices on the court, and a GOP-led Senate will do little to slow down any qualified conservative judge who Trump may appoint.

Then there’s Justice Anthony M. Kennedy, 80, the perpetual swing vote whose time on the bench is also nearing its conclusion.

“What we’ve had for years is a conservative court, but if any of those justices are replaced with a Trump nominee, it will turn into a hard-right court of the sort we haven’t seen in nearly a century,”...

“I think there could be radical changes in constitutional law,” Chemerinsky said. “Justices are justices for life, and this could be a conservative court for decades to come.”

IMHO, makeup of SCOTUS was the most important part of the election. Imagine an ultra-liberal court for the next 40 years. Brrrrrr!

Those two old fossil liberals will hang on till they carry their dead bodies out of the court after they croak. They do not want to quit and let Trump replace them with conservatives that actually know how to read the CONSTITUTION and actually know how to INTERPRET it!!! So, we will probably have to wait for them to die out of those two chairs.

I can’t believe some of the worst of the worst didn’t resign over a year ago so Obama could replace them.

I never thought I would say this but thanks go to Mitch McConnell. He refused to confirm Obama nominee Merrick Garland. What a big deal that is now. Just wow. Now we get a Trump nominee for the Supreme Court instead. Does any of the turtle haters on Free Republic realize what a big deal that is turning out to be?

The number of Supreme Court Justices has varied over the years.
There is nothing ‘Constitutional’ about there being 9.
The Congress could pass a bill on day 1 expanding the number to 12.
Trump could nominate 4 justices on day 2.
The Senate could approve them all on day 3.
But they don’t have the cahones to do it.

My sole reason for voting for Trump.

Not only SCOTUS judges but other judges down the line.

Ruth Bader Ginsburg was probably counting on Hillary being able to pick her successor. She will probably try to hang on as long as possible. If Trump serves 2 terms, she will be about 91 at the end of the 8 years. A few justices have lived into their nineties but I think all of them retired before their deaths. Oliver Wendell Holmes was about 91 when he retired.

Don’t leave out Kennedy. He’s been a disgrace and I believe he was a Reagan appointment.

But as you said, c’mon Grim Reaper, time’s a wasting! Trump appointing four justices would give the country a respite for 20 to 30 years from the Commies in the RAT Party. BTW Kagan is in her 50’s so she will be around for a very long time. Ditto for “the wise Latrina.

Apparently the Dems put pressure on Ruth Bader Ginsburg to go ahead and step down so Obama could appoint her successor, but she refused to do so. Her assumption was that the next president would be Democrat anyway, so she didn’t feel obliged. You know she will be feeling the wrath now!
