GOP's Merrick Garland Delay Tactic Salvages Conservative Agenda At Supreme Court
Forbes ^ | November 9, 2016 | Daniel Fisher

Sen. Mitch McConnell’s audacious — and roundly criticized — decision to block President Obama’s nominee to the U.S. Supreme Court pending the results of the presidential election has paid off handsomely for conservatives, who until this morning had every reason to suspect the end of their long-running project to reshape the court.

Donald J. Trump’s victory means the court will almost certainly have a conservative majority for years to come. Challenges to regulation by administrative fiat, class-action lawsuits and restrictions on property use will find a more hospitable court, while laws restricting abortion and promoting the rights of religious organizations will likely stand a better chance of surviving constitutional review.

I don’t think he’s a hero either, there were obviously a lot of forces in the GOPe at work for him to go .... “Hmmm, maybe I should fight this.”

We’ll never know the why but we do know the what.

I’ll give him this, it was a pretty risky move. We could have ended up with Schumer as the Senate Majority leader.

Lets cut the guy some slack.

The Senate is a tough place when you have back stabbing Gang of 8 scum bags like McCain and Lindsey Graham to deal with along with Harry Reid and some of worst Democrats in American history,

Yep. Give credit when due. This took back bone and was a well calculated risk. He kept almost everyone on script too. This was a rally cry for the election that likely kept some iffy voters from going 3rd party.

Sorry, Guys. As much as I believe McConnell has failed us, this is HUGE among his choices. It was also a gamble that the Garland nomination would be replaced by Hillary with an Elizabeth Warren or RBG clone. The impact here is HUGE.

Reshape the Court or hold onto it with their last fingernail?

Four liberals, four conservatives and one moderate. That’s been the Court ever since Reagan. The Democrats were lusting to get a five-liberal majority to rubber stamp all their unconstitutional changes and Scalia’s death gave them the perfect opportunity. One more reason God had to intervene for the good of our nation.

When Trump makes his nomination I suggest the House and Senate go into recess for a week. Because a recess appointment is the only way that person will wind up on the bench.

Amen, except for possibly the Supremes. Amend the constitution to make federal judicial appointments some odd number of years - 11 or 13, with no possibility of appointment to a higher federal court. This should make it difficult for any one administration to appoint too many judges during one term while still clogging the senate calendar to make it harder for the federal government to get anything done - gridlock is good.

This is the main hope that brought out a lot of Christian voters. In my opinion it was as big as building the wall.

THIS was the biggest reason to vote for Trump.

Every time the topic came up, I told people that they shouldn’t be distracted by all the NOISE about Trump-— That getting the Supreme Court with a conservative balance was much more important & would mean something for a much longer period of time.

Other problems could be solved—a wall can be built—the Border Patrol can be quadrupled or whatever they need, etc, but the Supreme Court was the largest victory we could hand the American citizens.

She already has been practicing retirement. She keeps falling asleep during court sessions.

With Trump Victory, Next Supreme Court Justice Will Respect the Rule of Law
One of the longest lasting effects of Donald Trump’s victory yesterday will be his nominations to the Supreme Court. Mr. Trump had released a list of people from which he would select the Supreme Court Justice or Justices he will nominate as President. Clearly, this list of principled jurists who respect the rule of law and Mr. Trump’s respect for the Constitution were important factors to voters. 21% of voters said the Supreme Court vacancy was a major factor in their voting decision, and those voters voted for Trump over Clinton 57% to 40%.

The Trump presidency has the potential to not only preserve Scalia’s legacy but also drastically shift the Supreme Court toward respect for the rule of law and the proper role of the courts:

The political earthquake that hit Tuesday night has enormous consequences for the Supreme Court, swallowing up Judge Merrick Garland’s ill-fated nomination and dismantling Democratic hopes for a liberal majority on the high court for the first time in nearly a half-century.

In the short term, Republican Donald Trump’s victory means that at some point next year, the nine-member court will be restored to full capacity, once again with a majority of Republican-appointed justices. . . .

The long-term question will be Trump’s ultimate impact on the court’s membership, and whether he gets the chance to do more than choose the successor to Justice Antonin Scalia, who died in February.

Two of the court’s liberals, Justices Ruth Bader Ginsburg and Stephen G. Breyer, are 83 and 78, respectively. Moderate conservative Justice Anthony M. Kennedy is 80. . . . All eyes will now be on the court’s oldest members, Kennedy and Ginsburg. Replacing Kennedy with a more stalwart conservative would immediately impact the court’s dynamics. He has given no indication about how long he intends to serve on the court.

The opportunity for President Trump to nominate a justice to fill Justice Scalia’s seat on the Supreme Court would not have been possible but for the leadership of Leader McConnell, Chairman Grassley, and many principled Republican Senators. The nation is indebted to these Republican Senators.
