I am VERY familiar with the issues raised, and the rulings, in Bush v. Gore.

The problem with your analysis is that the Florida Supreme Court had no authority over the plenary power of the Legislature to appoint Electors. This authority is conferred in Article II and is not derivative of any other right, power, or authority.

Whether the Florida Supreme Court ordered recounts, whether they ordered the Legislature to appoint Gore electors, or whether they ordered Katherine Harris to wear purple underwear and speak only Norwegian is irrelevant.

The USSC hearing the case was premised on the notion that the Florida Supreme Court was exercising authority it did not have.

How about the Governor of Florida sending the National Guard to arrest Brenda Snipes for treason against the State of Florida, and order the seizure and destruction of all the ballots in question?

Asking the courts to resolve these kinds of problems is putting their halter across your own shoulders.

Courts have no role in elections. They are not representative bodies.

Yep, and I was right there on 6th. St. in front of the court house shouting down the lying media while my friends were inside trying to stop the illegal recount. It was horrifying and exhilarating at the same time.

Actually the Supremes ruled twice in the 2000 election the 2nd Bush vs. Gore which stopped the recounts because they were using different methods and thus violated the equal protection clause, and the first which was Vacated and sent back to the Florida Supremes.

And Bush Vs. Gore most certainly did have a bearing on the outcome of the election.

The courts had no effect on the certificate of ascertainment sent by the governor to the Archivist of the United States.

If the court had not intervened under the new revised rules for counting overvotes Gore would have won the Florida Election.

The ruling stopped an illegal recount that had changed the rules midstream.

PRISON for the criminals who illegally opened those ballots. We will see how the counts on those come out and then argue about whether they can be counted since criminals contaminate4d them.
