With or without Scalia, the USSC has no proper role in the choosing of Electors for President and Vice President of the United States.

It was insanity on the part of Bush partisans to let them in, and it's going to be very, very difficult to get them out.

Elections in general, and the choice by State Legislatures of Electors in particular, are organic acts of the People (the sovereign). Courts are not the sovereign. They should keep their noses out of the People's business.
