Can FBI Revoke Immunity For Mills, Huma?

Any attorneys out there? Seems everyone involved got immunity except Hillary and have no incentive to testify.

A related question: If you have immunity and appear to be lying, is the immunity revoked? I say “appear,” because only a court can say if perjury occurred, as I understand it. What about lying during the investigation?

Absolutely not — unless of course, by some small chance, they could determine that those folks (I love it when Obama and Hillary use the word “folks,” ‘cause they’re such folksy people themselves) had lied to the FBI in the course of the negotiations leading up to the issuance of the immunity. Then the answer is “yes.”

But I can’t imagine that would have happened.

The next question would be whether anybody at FBI headquarter can locate a pair or balls, or a conscience. That’s actually going to be the harder part of this problem.

Not generally, unless they somehow breached the deal or misrepresented the facts in obtaining the deal.

I don't know if I could provide any actual insight, but here's an observation for ya: The FBI is corrupt, from top to bottom and from left to right. This alleged "investigation" that everyone is carping about is a bunch of BS. It's up to you, but you might save yourself a whole lot of aggravation if you just dismiss anything to do with the DOJ actually behaving in an impartial way and doing its job accordingly.

There's my $0.02.

I’m not a lawyer, but I believe it is a “deal” made between two parties. There are expectations on both sides. If one side violates those expectations, the deal is off.

Lying or withholding evidence after receiving immunity would probably squash the entire agreement.

You got the answer before I posted my reply to your first question. The lying is the thing. Which I guess good in the sense that there’ll be lots of grist for that mill, if anybody can be found who wants to operate the mill. Nowhadimsayn?

They cannot revoke the immunity agreements they have, but those immunity agreements deal only with information they provided. If the FBI (1) discovered a person violated the immunity agreement which required the person to be truthful and forthcoming the person’s action(s) will invoke the standard clause in such agreements voiding the agreement or (2) discovers criminal activity by an individual by independent means the FBI can prosecute based on that new information because such information is NOT covered by the limited immunity agreement.

Incentive is not really an issue, if the system is functioning normally and honestly.

When a person is subpoened, they must appear and testify. Their incentive is not important. The only valid reason not to testify is where they have a basis to invoke their Fifth Amendment privilege against self-incrimination.

When one is given immunity, it means “whatever you say that incriminates you, we won’t go after you for that crime.”

This removes the one good excuse for the person to refuse to testify. Any refusal after that is contempt of the body that issued the subpoena. E.G. contempt of congress or contempt of court.

But what seems to have happened here is that Hillary’s underlings were granted immunity and the FBI and Justice Department have decided to do nothing with whatever testimony they gave. Get Out of Jail Free Cards all around.

I am guessing if Huma and Mills breeched the agreement since the agreement was signed will be grounds to withdraw it. Otherwise, no.

The problem is that the last I knew. The FBI was refusing to disclose the Immunity agreements to congress. If that is true then how do you make a determination of what would violate it.

Most immunity deals simply guarantee they won't be prosecuted if they tell the TRUTH and testify in future litigation. Simply a means to go after bigger fish.

Clinton is the BIG fish and Obama/Lynch/Comey have rigged it to let her off.

If Clinton wins, FBI finds nothing.

If Trump wins, Obama pardons and Hillary gets to keep her ill gotten gains for retirement.

Either way, Hillary wins.
