The U.S.Department of Justice, on behalf of the United States, filed a motion in court Friday to get the lawsuit filed by the parents of Benghazi victims dismissed. The parents filed the lawsuit against Hillary Clinton, but the DOJ is now involved because the plaintiffs are suing her based on her actions as Secretary of State during the September 11 2012 attack on the U.S. consulate in Libya.
In the motion, Benjamin Mizer, with the DOJ’s civil division, said the plaintiffs hadn’t exhausted all of their administrative remedies before they filed a suit. On top of that, they claim the plaintiffs didn’t properly serve the U.S. government.

Let’s throw out, whom ever filed this!
Federal Tort Claims Act cases should only be filed by lawyers that know what they are doing - usually ex-DOJ types although some agency lawyers who interface with DOJ know the ropes. There are probably some exclusively private attorneys that have done enough to know what they are doing, but you certainly don’t want someone learning on your case.

Here are the rules of federal procedure Rule 4. Summons
(i) Serving the United States and Its Agencies, Corporations, Officers, or Employees.
(1) United States. To serve the United States, a party must:
(A)(i) deliver a copy of the summons and of the complaint to the United States attorney for the district where the action is brought—or to an assistant United States attorney or clerical employee whom the United States attorney designates in a writing filed with the court clerk—or
(ii) send a copy of each by registered or certified mail to the civil-process clerk at the United States attorney's office;
It is inarguable that a copy was delivered to the U.S. Attorney. Apparently the DOJ has appeared and has argued that this was done.

I do understand the use of the word SERVE here BUT just reading it is kind of unbelievable....
Especially with all the ink etc given the MUSLIM activist father because of a statement DT made - which - as usual, when ‘clintonized’ was taken out of meaningful context.
Yet these four families have virtually been ostracized by THEIR & OUR government for ‘abandoning’ their Children and all they want are some answers, NOT stonewalling four years later with the guilty party(s) walking around smiling and talking trash.
Actually, if her thighness gets elected these four families will more than likely be on the wrong end of a law suit or worse if ordered to ‘cease & desist’ and they don’t.
