....A South Florida man says he was banned from his condo gym because he wore his Donald Trump ‘Make American Great Again’ cap.

Is that legal? Help Me Howard with Patrick Fraser elected to check into it.

Nikos Henry is a young single guy … so it’s no surprise why he moved to South Beach.

In most cases (including this case) I support the right of any business to refuse service to whomever they dern well please.

In the particular case, I would also emphasize the right of the public to shower this business, as a consequence, with any reward or punishment that *they* dern well please, including the clientele boycotting them into bankruptcy.

Can I have an Amen?

it’s a condo association gym, how will people boycott them into bankruptcy?

Exactly, he is technically has a right to use it, since he pays for it.

Sure they have rules but about hats? Is it a general no hat rule or just that hat?

Do they also ban Hillary or BO shirts or hats?

“Can I have an Amen?”

No. It’s not that simple.

From the story: “The South Florida man lives at The Flamingo on Miami Beach where his lease includes a membership in the gym that’s on the property.”

“His lease includes a membership...” In other words he’s paying for it. If they want to ban him, he needs to get a refund.

As to “verbal harassment, I might consider the manager saying “you need to take that hat off” as verbal harassment.

He doesn’t need to “get a refund.”

He needs to get an attorney.

Do they ban Hillary hats too?

It’s his condo gym. They don’t have a “right” to deny him access or service.

He got screwed by a Lib tactic: provoke you into getting angry, then get you for “verbal harassment”.

When confronted by a Lib, NO MATTER WHAT, keep your temper, do not respond angrily, do not call them names. That’s what they want, do not take the bait.

And if you think you might possibly get into a confrontation (like you are wearing a MAGA hat in a Lib zone), have your cell-phone’s voice recorder feature ON. In Florida, they have “two party consent law”, which prohibits recording without the other person’s consent, UNLESS the conversation occurs “in a public place” (which the gym would be).

From reading the article he was banned for using abusive speech towards a gym manager. The apparent cause of the altercation was the management attempting to force him into not wearing a pro-Trump cap. When confronted by management after several attempts to force compliance, he admits to using abusive language. Thus the gym has an excuse to ban him not related to his right to wear a political statement. This was probably their battle plan once they found him resistant to ‘obeying’ their requests.

Lesson here, is that a polite but firm no is better than cursive speech. Lesson for him is that Miami’s South Beach is enemy territory and they can be very territorial! Of course, that describes a lot of the left, intolerant towards any views other than their own!
