Rep. Trey Gowdy implored FBI Director James Comey to explain his agency’s actions in refusing to prosecute Hillary Clinton for mishandling classified information when she was secretary of state.
“What would she have had to do to warrant your recommendation for prosecution?” the South Carolina Republican asked Comey during a House Oversight Committee hearing Wednesday. Gowdy wondered what other evidence was needed to prosecute Clinton if all that had been revealed in the federal investigation was not enough as he grilled Comey on the question of intent.
Comey noted that intent could be proved by looking at whether a person did something they knew was wrong at the time.
“But the way to prove that is whether or not someone took steps to conceal or destroy what they’ve done,” Gowdy declared. “That is the best evidence you have that they knew it was wrong, that they lied about it.”

A sub committie chair, congressman of a District has little power on their own. The Speaker sets the agenda of the whole House of Representatives. In this case, he isn’t even the chairman.
Intent is not part of the statute regarding the classified information sent, received, and stored on her computer. The coverup is another matter - there was clearly intent.
It remains to be seen what will happen when
Trump is the Executive.
