Appeals court considers Obama’s climate change plan

President Obama’s signature effort to combat global warming was alternately lauded as a reasonable attempt to move the nation toward cleaner energy sources and faulted as an unconstitutional, job-killing power grab during seven hours of vigorous legal arguments Tuesday.

With the Clean Power Plan’s future on the line, a 10-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit struggled to discern whether the proposal goes too far in trying to compel power plants to cut carbon-dioxide emissions. The Obama administration contends it merely used its authority to nudge the industry in a direction many companies already are headed — toward more renewable sources of energy such as wind and solar.

If this court finds for 0bama and the Regime, electricity and other fossil fuel utility prices will definitely "necessarily skyrocket."

I don't have much faith in sanity prevailing.

This should not even be in the courts. Congress should refuse to fund this anti-science crap. Instead we have a bunch of feckless idiots—Lyin’ Ryan and turtle face Mitch McDumbo in congress—they go well with the feckless fool on the hill.

Congress doesn't even bother to READ the laws it is enacting and, long, long ago ceded authority to Executive Agencies to write and enforce the regulations issued under such laws! Trump will have a HUGE job trying to turn things around! Reagan tried but only had limited success!

Remember that Obama, with Harry Reid using the “nuclear option” in the Senate, stacked the DC Circuit Court of appeals with 3 new liberal judges. They knew that all federal regulatory agencies that get challenged in court will go through this Appeals Court. So by stacking this court, they were making it almost impossible to overturn most of Obama’s regulatory executive orders.

Patriots are reminded that the states have never delegated to the feds, expressly via the Constitution, the specific power to regulate environmental issues for the states.

In fact, a previous generation of state sovereignty-respecting justices had clarified in broad language that power that the states have not expressly constitutionally delegated to the feds are prohibited to the feds.

”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.

Also, the corrupt, post-17th Amendment ratification, state sovereignty-ignoring Congress has the constitutional authority to stop Obama from harrassing the states over environmental issues, but stubbornly refuses to do so.

Remember in November !

Patriots need to support Trump / Pence by also electing a new, state sovereignty-respecting Congress that will not only work within its constitutional Article I, Section 8-limited powers to support Trump’s vision for making America great again for everybody, but will also put a stop to unconstitutonal federal taxes and likewise unconstitutional inteference in state affairs as evidenced by the Obama Administration’s environmental regulations.

Note that such a Congress will also probably be willing to fire state sovereignty-ignoring activist justices.
