(WISH) – Governor Mike Pence and two other Indiana officials are being sued by a transgender immigrant from Mexico who was granted asylum in the United States in 2015.
According to court documents, the plaintiff is suing Pence, Attorney General Gregory Zoeller and Marion County Clerk Myla Eldridge for enforcing a state law that denies him the right to change his legal name. The suit was filed by lawyers at the Transgender Law Center and the Mexican American Legal Defense Fund.
The law, which was signed by the Governor of Indiana on March 17, 2010 and went into effect on July 1, 2010, requires proof the person is a United States citizen. Governor Pence was not the governor at the time the law was passed, but he passed a religious freedom law during his term in office.
According to court documents, the plaintiff is identifying himself as John Doe instead of his legal name Jane Doe in order to remain anonymous.
The 31-year-old, who is a transgender living in Indiana with a wife and child, was granted asylum from Mexico in August 2015. Court documents said he has been denied the right to change his name from Jane Doe to John Doe, and is being harmed by the Indiana Code Section 34-28-2-2.5(a)(5) since he isn’t volunteering to provide that information and can be humiliated. He fears if people find out he is transgender he will be targeted.
According to court documents, he is unable to update names on ID cards and other records, therefore violating his rights under the following:
The Equal Protection and Due Process Clauses of the Fourteenth Amendment The Free Speech Clause of the First Amendment The lawsuit provides three humiliating examples of him presenting himself as a male, but having a female ID.
