It's Tax Refund Time for Illegal Aliens(2/2/2016)

Some people in the United States have already filed their 2015 income tax returns — not because they are super-law-abiding, but because they want to get a check from Uncle Sam in the mail. Some savvy illegal aliens, since they can get substantial tax breaks, will have filed by now.

The first day that IRS accepted returns was January 19 this year — the deadline is two and a half months away, the usual April 15.

This year there is yet another tax break for illegals in the tax system. Unlike citizen and green card workers who are not participating in Obamacare or another qualifying plan, who will be paying a penalty of up to $695 per adult (with a family limit of $2,085) for not joining the system, illegals without coverage pay no penalties. None at all. These penalties were much smaller last year.

That is also true for the semi-illegals covered (for the moment) by the DACA (Deferred Action for Childhood Arrivals) program. (On the other hand, these illegals and semi-illegals cannot — legitimately — be covered by the insurance, though some must be beating that system.)

macare tax break, which simply reduces the amount owed, it is the Old Faithful of tax breaks that illegal aliens can access: the Additional Child Tax Credit (ACTC). Illegals filing their income taxes can claim the ACTC if they have (or claim to have) children in the United States. This tax credit, unlike virtually all others, can result in a negative income tax payment. That means that no taxes will be collected from the individual, but he or she will get a check in the mail for all taxes withheld plus a bonus for the credit, as my colleague Jim Edwards has reported in the past.

The ACTC is well worth filing for; it can be as high as $1,000 per child claimed and proving the existence of a child is all too easy, with an ID number issued all too casually by the IRS, as we reported a couple of years ago. This is now called the TIN (tax identification number) and, in the immediate past at least, it was issued in such a sloppy way that the process was roundly criticized by the inspector general of taxation for the Department of the Treasury.

There are at least three kinds of children that an illegal can claim for the ACTC: actual citizen kids living in this country; actual children living abroad, but claimed to be living in the United States; and, at the bottom of the ladder, nonexistent children. The IRS has created a system that makes it very hard to distinguish between these three classes.

A somewhat similar tax program, the Earned Income Tax Credit, requires a Social Security number for the claimed children, and thus is a bit harder for illegals to misuse.

This is an old article, but I don't think it was ever posted.

It seems confirm my thought that a large number of illegals do not owe any back taxes because they have been gaming the system all along. They have been filing yearly tax returns and getting refunds for credits.

This is why the wall needs to be built, E-Verify enforced, and ALL illegals sent home. Not to leave out Americans, eliminate the Earned Income Tax Credit.

It has been in practice for years, and the illegals are a lot smarter than the liberal bureaucrats.

What the illegals do is get an employer to set them up for tax withholding, but only report a small portion of their pay.
Most of the money is paid under the table.

The small money that is taxed then qualifies them for the EITC and other tax benefits and welfare.

A smart illegal, say in the landscape business, can make $30,000 in pay, and another $15,000 in benefits and tax reimbursement under this system.

It is already lost - all one has to do is look to Mexifornia where illegals are now allowed to vote and run for city council seats in some communities. IT IS OVER, Americans way too busy watching sports and porn to be bothered with what is happening on the political scene all the while the Corruptocrats in the District of Corruption have been raping us all.

I can verify to you that, by the end of January, there are nothing but Spanish-speaking only tax prep firms up and operating in SoCal. My job entails making reservations for many taxi companies across the United States.

Correction: This is why: WELFARE must end (aside from the violations of the 5th\13th), a TRUE reading of the 14th (no ‘anchor babies’), all ‘free’ services (schools, hospitals and the like) be paid, directly, by the end-user, the 16th scrapped and, having whittled down govt by the ‘lose of funding’, institute an across the board federal sales tax (paid proportionally by each State).

NOBODY should 1) pay 0% in taxes 2) get $$ ‘back’ they NEVER earned.

IMO, the e-Verify is shifting the job of govt (border\immigration enforcement) upon biz...yet again.

Follow the Law to a ‘T’ ( vs. sanctuary cities\laws) and, if in ~5yrs there is STILL a problem, THEN build the wall.

Hell, toss in a Reciprocity Act (violators AND collaborators will be subject to the same laws as their home country, compounded [be great vs. those in govt that way]) and I bet they go RUNNING back home.

We also have lots of legal citizens doing the same thing. Work part time and then get EITC. The illegals and criminals know more about our tax code than voters do.

IMO, the illegals aren’t here for the jobs, it’s the ‘taxpayer goodies’ (govt aiding and abetting w/ their ill gotten ‘gains’).

I also have a problem w/ 1) requiring biz to do the job of govt (whom govt can demonize and burden further) 2) requiring ‘permission’ from govt to be gainfully employed (E-Verify isn’t just used for the brown people).

Now, if we wish to up the ante on the ‘hiring an illegal’ (and ACTUALLY *prosecute* a few big names), that may make others think twice...

The only way to really impact businesses is to hit them in the pocketbook. Enron type prosecutions are all well and good. Hit them where they live, aka profits, most will immediately obey the law.

The hiring of illegal aliens has always been the way big business maximizes profits at the expense of taxpayers.
