In an 18-page decision issued late Monday, a judge denied a motion by Paramus Catholic High School to throw out a lawsuit filed by a former employee who was fired because she is in a same-sex marriage.
Superior Court Judge Lisa Perez Friscia issued her decision after hearing oral arguments Friday concerning a lawsuit filed by Kate Drumgoole, the former dean of guidance and girls basketball coach at Paramus Catholic, who was terminated in January.
The school says she was fired not because shes gay, but because she is in a same-sex marriage. The case, first reported by The Record, has drawn regional attention and was widely covered by television and radio reporters on Friday.
Christopher Westrick, the attorney for Paramus Catholic, its president James P. Vail and the Archdiocese of Newark, filed a motion for summary judgment, touching off a church-versus-state debate.
In the motion, Westrick said the defendants didnt violate New Jersey Laws Against Discrimination because its within the law for churches to require employees to subscribe to their tenets. And, he argued, the defendants conduct is protected under the First Amendment, which guarantees the free exercise of religion and freedom from government entanglement within religion.
Westrick told Friscia that absolutely prevents this case from going forward.

During the debate over gay marriage, the gay activists would often argue "how does my marriage negatively affect you??"
I think we have our answer. All along this was a zero-sum game in which basic First Amendment freedoms have been eviscerated.
