Iran ex-president writes to Obama demanding frozen funds

Former Iranian president Mahmoud Ahmadinejad, rumoured to be planning a political comeback, has asked Barack Obama to return $2 billion of assets frozen in the US in a letter made public Monday.

Ahmadinejad wrote that despite early promises by the US president to improve ties with Iran "the same hostile policies along with the same trend of enmity were pursued".

He specifically mentioned the $2 billion of Iranian foreign currency reserves seized from New York bank accounts earlier this year.

In April, the US Supreme Court confirmed an earlier ruling that the money should be used to compensate the families of victims of the 1983 bombing of a US Marines barracks in Lebanon and other incidents blamed on Iran.

That 2 billion is supposed to go to American citizens by way of court order. What is the holdup?

If the funds are held in a bank, and it is in an account held by the government of Iran or some other Iranian interest, the bank has to follow the Court order freezing the funds. If 0bama tries to order the funds transferred to Iran by Executive Order, the bank will probably have to sue to declare the order invalid. The bank clearly has an interest in doing so, because:

1. The Executive Order would clearly be outside any powers granted to the Executive under the Constitution, and

2. If the bank chose to follow the Executive Order, and violates the Court order, not only would the bank executives be subject to a contempt citation, the bank would be directly liable to the American victims of Iranian terrorism for any judgments they obtained.

Not that I don’t think 0bama wouldn’t try to get the money to ValJar’s buddies in Teheran.

Since 1983, many mothers and fathers of the 1983 soldiers murdered in Beirut have died, and it is those soldiers' children, or brothers and sisters who continue to wait for their government to intervene on their behalf, and to see that the funds the Court has declared due them are paid.

Now, they see betrayal and cowardice on the part of their own government regarding their plight as families, as this news has been publicized.

Obama should keep the funds and distribute them to veterans who have been killed (family members) or maimed in the war on terrorism and against ISIS!

(a) Whoever receives, possesses, or disposes of any money or other property, or any portion thereof, which has at any time been delivered as ransom or reward in connection with a violation of section 1201 of this title, knowing the same to be money or property which has been at any time delivered as such ransom or reward, shall be fined under this title or imprisoned not more than ten years, or both.

(b) A person who transports, transmits, or transfers in interstate or foreign commerce any proceeds of a kidnapping punishable under State law by imprisonment for more than 1 year, or receives, possesses, conceals, or disposes of any such proceeds after they have crossed a State or United States boundary, knowing the proceeds to have been unlawfully obtained, shall be imprisoned not more than 10 years, fined under this title, or both.

(c) For purposes of this section, the term “State” has the meaning set forth in section 245(d) of this title.
