No double standard for Clinton, FBI director tells GOP

Under an onslaught of Republican criticism, FBI Director James Comey vigorously defended the government’s decision not to prosecute Hillary Clinton over her private email setup, rejecting angry accusations that the Democratic presidential candidate was given special treatment. […]

Comey said investigators found no evidence that Clinton or her aides intended to break the law, even though they mishandled classified information. A misdemeanor statute requires the mishandling to be intentional, Comey said. A law that permits felony prosecution due to gross negligence has been used only once in the 99 years since it was enacted — and that was in a case involving espionage.

“We don’t want to put people in jail unless we prove that they knew they were doing something they shouldn't do,” Comey said. “That is the characteristic of all the prosecutions involving mishandling of classified information.” …

I see some tremendous confusion on the part of Comey.

Even if "intent" is required for conviction, it is not "intent to violate the law". Rather, it is "intent to commit the act which the law forbids".

The mishandling of classified material by Clinton and her conspirators was not unintentional. They intentionally created a server apart from the classified systems. They intentionally exchanged emails on that server; in Hillary's case to the exclusion of any other email.

They intentionally included in those emails classified information. They only thing they didn't intend was getting caught.

That is totally untrue. There is no intent clause.

Tht is not how the law works either. Ignorance of the law doesn’t bail any regular person out of breaking the law.

At least not the severest of crimes.

This is why all of fedgov needs to go. Every bit of it.

I seriously do not think any of our leaders know just what they are going to reap from all this.

How can the so called smartest woman in the world not know exactly what she was doing was obviously wrong and criminal?

You cant have both. Either shes way too dumb to be trusted to be president or she is a massive liar who knew what she was doing and cant trusted to be president.

This is a giant offense to anyone who has ever held a security clearance and kept it clean.

Really, the entire affair is most outrageous for a reason no one has commented on, which is that the defense of Clinton mounted by Comey is so preposterous, so laughable, so completely ridiculous that it's clear our masters aren't even trying anymore.

It's nothing more than a naked power play, pure and simple.

Note added in proof: Comey's supposedly comprehensive investigation revealed nothing that was not already widely known via Congressional Testimony, FOIA requests, Judicial Watch, and other open sources. In other words: the much vaunted "FBI" uncovered nothing, revealed nothing, and did not even bother to pretend to mount much of an investigation.

The man ended his announcement press conference with a warning to other people in the government that no one should think they can get away with what Mrs. Clinton did.

He said it on national television.

It begs the question “Why did she feel compelled to have a private server, when she had a “.gov” address already and conveniently ready, usable and more secure, if she wasn’t doing something that she needed to hide?”
