Sounds like the 4473 was filled out for the background check and sale was denied. The dealer then sold the gun anyway. That is the only way the BATF can know the buyer, seller and firearm serial number.
If the sale is approved, the BATF is supposed to destroy the 4473 info in 30 days. Because the sale was denied, I suppose they can keep the info as long as they want.
That they looked the other way with the full-auto find makes the bad odor pretty strong on this incident.
If the press covers it, the story line will be that guns are too freely available, and more laws need to be passed.
I know, that is a totally illogical reaction to the facts.

Not stating this as fact, just what I read from the article, the issue is that the weapon is full automatic. Transfer of full automatics requires a personal vetting by the feds.
Oh they have...one of the guns used yesterday in the Turkey bombing was believed to be sent from Phoenix...how interesting huh???

Exactly. It is common for slightly different models to have the same serial number. I thought this had been debunked before. One gun an AKM or variant; another a semi-auto variant with the same serial number.
Simple confusion of same serial numbers, slightly different models, issue.
The fact that the guy wasn’t charged with anything screams he was one of the ATFs “walkers”...
Probably because the weapon was going to cross state lines/national boundaries?
Maybe he sold it to a foreigner?

My question is how they tracked it back to him and an illegal gun purchase? Just via serial number? on an illegal gun? I’m certainly not ruling out in my mind that it was F&F.
