The federal investigation into an FBI agent's apparent firing of gunshots at Robert "LaVoy" Finicum and the alleged FBI tampering with evidence at the scene has gone to a grand jury.
Assistant U.S. Attorney Charles Gorder Jr. revealed the grand jury hearing in court papers Thursday explaining the government's desire to keep its memorandum about the inspector general's investigation into the FBI's handling of the Jan. 26 shooting out of the hands of defense lawyers.
"The Declaration provides details of an ongoing investigation by the United States Department of Justice, Office of Inspector General, and concerns matters occurring before the grand jury protected from disclosure,' Gorder wrote to the court....
Defense lawyers in the Oregon standoff case have asked the judge to compel the government to turn over the investigators records regarding the FBI's alleged misconduct.
Late Wednesday, Brown said she'd allow prosecutors to file the memo under seal, but ruled it must be shared with defense lawyers. She said, however, that she would allow the government to make further argument why it shouldn't be shared with the defense.
That led to Gorder's expanded legal brief, noting the federal investigation is before a grand jury......
Updated June 24, 2016 Defense lawyer Per C. Olson replied to Gorder's filing, saying federal law allows for the court to authorize disclosure of a grand jury matter if it's connected with a judicial proceeding. Olson urged the court to accept the government's memo under seal, but allow defense lawyers access to it....
Judge Brown rules prosecutors haven't met the bar to file the document only with the court, so must file it sealed, and share it with defense lawyers.
The practice of filing legal briefs out of the eye of one party in a pending criminal proceeding, the judge wrote is "strongly disfavored."

The FBI killed LaVoy and these agents deserve more than perjury charges for lying and covering up their gunshots.
We shall see what this grand jury thing is all about as we move on.
The federal prosecutors are using the grand jury to justify withholding evidence from defense lawyers ahead of the trial for the protestors at the refuge scheduled to begin September 7th.

Its a federal grand jury and we don’t know what kind of charges, if any, will come out of it. Lying and tampering with evidence seem obvious. All five agents denied shots being fired and the drone shows them searching the snow to remove the shell casings observed by Oregon law enforcement right after the shooting.
And we are the most degenerate people to populate America.

That will rankle some, but it is our own apathy and lack of drive and personal courage to face up to the PC movement (silent majority sitting with their thumbs up their butts) that has allowed things to go the way they have.

Now that he has made a false official statement, lied to investigators, picked up his brass, and gotten some other agents to lie with him, they are all toast. The best they can hope for is no criminal prosecution, but they can't be agents anymore because the record of this incident would be discoverable in any other case they are involved in.

The FBI HRT are guys whose tool box only has a hammer. Mr. Finicum was determined to make himself look like a nail.
Driving away from a law enforcement stop, jumping out of a vehicle after almost hitting the road block, rapid furtive movements, and multiple cries to "just shoot me" aren't ways to a peaceful outcome.
Everything proceeded just as the authorities wished. And they got just what they wanted.
They forced a man into a box to get the reaction that they knew would come. His reaction to their ambush is their justification in killing him.
The statements of the 2 OSP shooters that both shot LaVoy Finicum in the back were textbook. The FBI shots missed their targets but they just couldnt resist popping off a few rounds with everyone else. Then lying about it.
If it was an ambush, why didn't anybody else die? All the other protestors gave up. They all swore to go out shooting, but somebody forgot to tell Lavoy they didn't really mean it.
Yeah, sure. OK.
